I was working for a software consulting company in US till March 2002. From July 2001 to March 2002 my employer couldn't find me a client to work. So I didn't have a job and was not paid during that period i.e. W2 for 2001(partially) and no W2 for 2002. In March 2002 I returned back to India. The same employer has sent me new H1 papers again a few weeks back. I submitted them for my Visa in drop box since it is less that 1 year my earlier Visa expired. I got back a query asking me to submit W2's for 2001 and 2002. I don't have one for 2002. what should I do? Would there be a problem if I just submit the W2 for 2001?

Did not they inform you that you should come for interview? Or just asked to submit W-2 I hope in your case they will call you to consulate. As you have worked in the past in US with the same employer and your new H1B is from they SAME employer that did not pay you minimum LCA salary in the past and you have past W-2 issues. They will need an explanation from you and may investigate the past and current employer (same employer in your case) as he violated DOL and H1B regulations in the past. What is the guarantee that now the same employer will pay you the minimum LCA salary? I hope you may be facing problems and it will be difficult to cover up the employer for past violations. Better go to consulate and give the explanation if they ask. If it is Chennai consulate many are facing problems to get H1 or H4 visa.
Good Luck!!

visa stamping status

Helloboy,
Please let us know your status.
One of my friend had a similar problem. But in his case he had a letter from the employer stating that he was unpaid and he was in India during the unpaid period. When he went for stamping, he was asked to attend an interview at the chennai consulate. Also he is at his 7th year of H1b. I guess his stamping was cleared in the interview. I do not know exactly what was asked in the interview.

Thanks.
