VSC Processing Times Update

The processing time @ VSC is, therefore, eleven months. If your case is taking significantly longer (like mine), that probably mrans it is stuck with FBI security check.

At this point I am curious whether there are a lot of others with 2003 cases still pending.
USCIS needs funds $$$, thats it. they can get it by delaying the cases.
The "Security/Name-check" is an standard excuse for everyone.

Sorry to hear about your case. Mine is a tortuously long case too. Those who filed before Dec 1 2004 and have current PD and are still waiting - are they all stuck in name check?
Is there any other reason people are held up?
 
I would say the vast majority of unadjudicated cases filed significantly earlier than December 1, 2004, are stuck with FBI name check.
 
My I-485 RD is March 2003, PD is current. I recently became aware that VSC sent my name check request to FBI only in March 2005! and it is still pending.

I have filed a lawsuit since then. Now court is waiting 60 days to receive VSC reply to summons.

As far as I know, At FBI only one-two groups in DC were handling requests from BCIS (Nothing special for VSC). Most of resources were allocated to Terrorism (for obvious reasons). Very recently they have streamline the process and now they are processing cases based on Request Date.
Based on your common name and HITS on your name, case time response time will vary.

Can you detail out about your case?
Certainly they took way too much time to forward your request.

I have filed a Mandamus Complaint in a district court in late October. I prepared and filed this Complaint myself - pro se . The cost of filing is $250.00 plus cost of serving summons to all defendants (~$40). I wrote my complaint based on complaints from several similar cases I found through PACER court service center:

All complaints I used are very similar - almost word-to-word. Just plug your own name and discribe your own history of USCIS inquiries and attach your documents in "Exhibit" section.

As for my case, it is in EB1-OR, "other country" category. ND=PD=March 2003. I have done about 5 status inquiries, 3 expedite requests, congresswomen, senator, FBI FOIA. I went to the point when USCIS wrote me a letter saying that I should stop sending my requests to them and that they will stop answering them. This letter is a nice addition to my lawsuit in "exhaustion of administrative remedies" part :)

There is a separate thread regarding filing a lawsuit against USCIS, you can find a sample complaint letter over there. I wish good luck to all people who can find time and courage to fight for their cases.

Gegemon keep us posted - that may be the only recourse for me as well (stuck in name check - wrote several times to FBI, senator, USCIS).

Here is a recent success story of filing a Mandamus complaint. It is for a naturalization application, but applicant was stuck due to a name check process. His application was approved within 60 days - this is a time that court gives to defendants to reply to your filed complaint.

My court case is mooving along. I think that there is a good progress on it. 60 days given by the court to defendants have expired this week. And I have got a call from US Attorney that my FBI Namecheck has been expedited right after my complaint was filed in the court. And my namecheck finally cleared!
She asked for a 30 days extension of time so that VSC can complete the remaining adjudication stuff. So I agreed on that and waiting for a decision.
I hope that there will be no RFEs or transfers to local offices. My fingerprints are about to expire in a week - so this is another concern.
