VSC Processing Times Update

Did you or your attorney open a liason enquiry? What did they say.
It is sad that the old cases are still stuck while they keep moving the dates ahead on paper.
Did you wait 4 years to file i-485, if I amnot misunderstanding??

Its a long story. I lost my job in my GC sponsoring company 2 months before the I-140 was approved. 4 years later I rejoined them and they filed for my 485. 6 months later I changed job.
I initiated enquiry with INS. Got standard response, security checks pending due to lack of manpower.
Initiated enq through senator. Still waiting for resp.
Also wrote to Hardy (FBI). still waiting for resp.
Went to INS(Newark) 2 days ago. Was a total waste of time. I wish I had not gone there. They have no idea about the case and say I cannot change jobs until 485 is approved. They are completely ignorant about AC-21 etc.
Only thing I havent done is FOIPA.
 
I think the Service center people dont know or wont discuss the law or rules, they can only tell your current status what their computer system shows, sometimes the local office is useful in issuing interim EADs only.
In my case even that was of no use because my processing is from VSC and I am living in Central zone, which comes under NSC and the local office rep said she cannot issue interim EAD. My EAD initially had an RFE of color passport pages, and photo ID , later I replied to RFE, itseems they issued EAD but unfortunately niether the online status changed nor did I receive the card. I waited and waited and when Iwent to local office atleast then I knew that it was approved. It was surprising that the local USCIS office rep was able to look at the correct status of the case but was helpless.
Our lawyer then opened laison enquiry which directly deals with VSC head, 30 days after initiating that I got the card, they even issued a new EAC number with that.
ANyway, goodluck and hopefully the waiting will end soon.

After much consideration I have come to the conclusion that at this point the date may reflect the situation more or less accurately for those of us whose applications are not stuck at the name check. Unfortunately, mine is.

So, if yours is way past the processing time, you may want to find out your name check status.


... and also folks who has been retrogressed.
 
Liason enquiry

Thanks for mentioning the liaison enquiry.
I had never heard of that before. Can that be done through my new attorney or it has to be done by the attorney through whom I filed my 485.
 
In my case my attorney did that because I told them that I have a confirmation from the local USCIS office that my EAD was approved but I didnot get that and also the online message never said that. However the local office rep printed the correct status message which didnot look like our general online status, but she didnot give it to me, she just showed to me and then trahsed it. There was no printed evidence with me that time. Also when I called and even when my attorney called the customer service over phone and waited for 30 days before all this, it was of no use.
I think if you changed the lawyer then you have to sign the G-28 form and send it to tell USCIS that your new lawyer is representing your case. If so then they can launch that enquiry. Ask them if your case now is eligible for USCIS enquiry.

It may not be true for all the cases.. my name check process was done in APril 2005 and my 485 was filed on Nov 2003 (Pd is 04/09/2002).. still no movement..
 
It appears to be true in your case, however, for your delay seems to have been caused by name check. In many cases they adjudicate within 30-60 days or so after the name check is cleared. Your case is not out of this time frame.

This makes my application date more than a year behind of the current processing date.

Update Observations:

1. If you filed way earlier than this date, your application is most likely stuck in FBI name check.

2. It seems that filing a FOIPA request and then asking FBI to expedite the name check based on "no records" response from FBI is in most cases ineffective. If you have not gotten a response to your expedite request based on FOIPA from FBI for about a month, the chances are FBI will not respond to you at all.

I know this last observation will be discouraging to some. However, it is better to be aware of that, so you do not pin all your hopes on FOIPA.

how do you know your name check was _rejected_ by the FBI computers first time ?

Today I got not very good news... they told me, my name check was requested in March of 2004 (not 2005 as I expected), and is still in a pending status...

I agree with you that FOIPA would not help expediting name check, as it looks like it didn't help in my case... it's already 1,5 month since I sent an expedite request letter to Mr. Hardy's office....

If you have filed much earlier and your application still has not been adjudicated, then most likely you are stuck with FBI name check.

For those folks I have a piece of bad news: someone has recently lost a Mandamus court case to USCIS in Alexandria, VA. That case was an AOScase stuck with FBI name check, which was pending for almost two years. The court determined that national security warrants such a delay. I got this info from a couple of lawyers today. They did not know the details, and they heard of this case from somebody else.

If you have heard of a Mandamus law suit filed on AOS case, or know somebody who has filed such a suit, then I am sure many would appreciate sharing that information.
