They only update the status to tell that they've sent an rfe but the status doesn't tell what the rfe is about. Yes, the LUD changes.

I-140 Approved after RFE

Guys,

Just got an email saying my I140 has been approved and even the online status changed. Lot of people have guided me through this process and I thank every one of them.

Special thanks to unitednations, dazzling, neelbuddy and Goodluck_140.

RFE is about education evaluation, it was not attached along with the initial filing.

FP - 12/16/2004
485 LUD Changes: 12/21/2004 and 12/23/2004.

140 LUD changed 01/07/05.
140 STATUS/LUD changed 01/21/05 (RFE)
RFE Received on 01/27/05
RFE Response Set on 01/28/05
I140 Status Changed on 02/01/05 and 02/02/05 (RFE Response Recieved)
I140 LUD ON 02/07/05
I140 Approved on 02/11/05
 
RFE for I 140

Hi All,

Today I got an email. Felt happy for a second and then when I saw RFE note there, started worrying. My EAD/I140/485 updated twice, 1/28/2005 and 1/31/2005 with no message change and now all of a suddent today i got RFE note on I140. This again proves the point some one has mentioned on this forum. Please suggest me what will be the RFE. I know I have to wait till I get the notice, but any idea's?

Two weeks passed after LUD change, still waiting.......... I may get RFE.
 
Guys .. what is the pattern for LUD ...

Guys:

I got a RFE on my 140 - my attorney replied to it the very next day and USCIS acknowledged the RFE (See my signature). Then I got LUDs for 3 days 8th, 9th and 11th. Nothing after that.

1. Do you think this is a RFE again ?
2. Does USCIS generate multiple RFE (ie. re-issue a RFE after one has been replied to) ?
3. How long does an USCIS officer take to decide on a case after the RFE is replied to ?

Appreciate your exprience.

Hi,
Can you please clarify what you mean by "USCIS acked the RFE"? How did they do that? Did the online message change to says that response to rfe was received? or just the LUD changed?

USCIS acked the RFE - their website says:

"On February 8, 2005, we received your response to our request for evidence or
information. It is taking between 90 and 485 days ..."

Thanks, msd gc! You have me really worried. My lawyer sent the rfe reply last month but there is no such ack message online. Only LUD has changed and the message is still, "We have requested further evidence..."

Can anybody please tell me whether it happened with them too?
 
140 Approved after a RFE.

I got an Approval Late Yesterday. RFE sent 8th, Approved 16th. I will change my signature.

AP approved - 2 july 04

Below are the exact wording of the RFE.

Submit the 2001 and 2003 United States federal income tax returns (s) with all schedules and attachments, for your business. If your business is organized as a corporation ,submit the corporate tax return.If the business is organized as a sole propritiership , submit the owner's individual tax return(Form 1040) as well as schedule C relating to the business.

As an alternative you may submit annual reports for 2001 and 2003 which are accompanied by audited or reviewed financial statements.

Will the prospective employee fill a newly created position? ______ If your answer is no how long has this position existed ?______________ What wage have you been paying the incubment to this position? $_______/year. Identify the former employee ,submit evidence of the salary paid to him or her, and document that the position was vacated. Submit copies of form 941 for the period in question.

Any clues or someone who had a similar RFE and got approval for the same.
Its been sitting there doing nothing for the last 3 1/2 months and no movement on the case.

Any suggestions gurus !!!!

Your theory is right in my case.
For My 140 first LUD changed 02/02/2005 (but message remain same), today again LUD changed 02/17/2005, but this time, message changed to RFE is mailed. So I am waiting to see actual RFE.
 
After responding 140 RFE , LUD changed many times(Please see below), I recieved finger print notices on 2/14/05 for 3/1/05.

1. Does this mean my 140 is going to be approved
2. Is there any relation between 140 and 485 interms of finger print notices
what I mean is, LUDs on 140/485 changed at the same time after replying to RFE, I am assuming if my 140 is denied they wont send finger print notices, does this make sense?

I am in the same boat. 140 not approved and got RFE which was replied on oct 18th 2004. Still awaiting approval.

Got FP notice yesterday for appointment Mar 31st 2005 at Newark for self and spouse. No LUD or message changes.

Did you do any inquiry by calling 800 no, i heard in this forum that u can talk to VSC ppl directly.

When i called that no., they said my case was assigned to the officer on Feb'8th and it may take 30-60 days to get the approval/denial.
 
LUD changed .

Gurus please advice . My LUD finally changed for I-140/ 485 after RFE replied and recv by CIS on Oct 13th 2004. Got a FP notice recently. IS this moving somewhere ?? Please check signature and comment. Thanks
