Avoid Status Checks on Labor Certifications
Companies, beneficiaries, and attorneys need to be considerate of Department of Labor office staff workloads by only calling to inquire about the status of LC or RIR cases when they have a file with a problem or unusual delay. One way to tell whether a delay is unusual is to check the processing time information in the specific location to see on which cases work is currently being done. For example, we received a recent update from the Maryland State Workforce Agency (SWA) indicating that they are currently processing RIR applications received on April 24, 2001.

Excessive numbers of status calls have created such a problem at the SWAs that many of them have, in fact, specifically asked that people not request status of cases filed later than the processing dates given. Sufficient resources for responding to the high volume of inquiries simply are not available. We know that this is a problem in many states since there is just one small group of people to handle both the inquiries and the cases. Besides Maryland, New York, New Jersey, and California also have specifically requested that no status calls be made to interrupt their work on LC or RIR cases.

We at The Law Office of Sheela Murthy thought it may be helpful to point out an important difference between the INS and state agencies that process labor certification applications (known as "state workforce agencies" or SWAs). At INS Service Centers and local District Offices, there are Immigration Information Officers on hand to answer status inquiries and a separate group of folks, usually called Adjudications Officers or Examiners, who process the cases. One can inquire about a case without that inquiry interrupting the work being done on the case.

In contrast, the overworked staff who process labor certification (LC) applications are responsible for fielding inquiries as well as processing cases, both at the local and regional U.S. Department of Labor offices. In order to get through a substantial backlog of applications, it is critically important to devote as much time as possible to case processing by minimizing interruptions.

At MurthyDotCom we provide an official U.S. Department of Labor (DOL) processing chart that has approximate processing dates for all states and regions. You can find the chart at <http://www.murthy.com/labdate.html>. So, for example if the case is in Minnesota, you can look for Minnesota on the chart and see that the SWA there is currently processing cases filed in February 2002. Ultimately, there is a great benefit to all applicants if the SWA can work on their cases without having to stop and answer calls that will result in further delays.

I am finally able to post again!. I had a tonne of post/reply problems and changed my password innumerable number of times...finally I got thru--thanks to folks here at immigration.com.

Great to hear that we are moving along. Let's keep our calls to SESA to an absolute mimimum. Now that we are aware that they are moving at a fair pace, let's restrict our calls. I for one have been updated as to the dates SESA are processing *ONLY* (and if I might add reliably) from this forum. Thanks and Kudos to all who kept track and informed. Good luck.
As for myself myPD is pretty late than most of you here...July 31st!.

But I am willing to wait...knowing that all on this forum are happily on their way..judging from the responses of a couple of us...in past few days.

Concurrent Processing of I140 and I485

Hi Guys,

Good news for all of us. INS is releasing the regulation for concurrent processing of I140 and I485 July 31 2002. We all will hopefully benefit from it. Keeping our fingers crossed.

The VA SESA is moving along in the meantime. The only thing we need to know is how many applications they have for June , July, Aug etc. They have been processing May for last 15 working days and if they had 600 apps knowing how many days it takes them in all we can guesstimate the time when they should be processing our respective applications.

What does this INS regulation mean? How is it going to help us. Please explain.

Still need LCA

What I understand is we can process I4-0-485 concurrent but we still have to wait to get approved our Labour which is now main issue we are facing. Please update what you guys thinks.

concurrent processing

Hi all,
I need some answers.
My situation is I was working for Company A and company A applied for my GC.
I switched over to Company B.
Now at what stage of GC, i should go back to company A.
Since we can file for the 140 and 485 concurrently and EAD at what point i should join the company A.
Is it after 485 approval or what?

I think a lawyer would be the best resource for this. May be you can pose this question to Jim Mills he usually has postings on the I140 and I485 threads. But my best guess would be when you apply for your EAD you will have to go back to your old company.

Filed with VEC last year with a Receipt date of June 22 2001.
Receipt is out of the Richmond office. (2 others were filed from my company with the same Receipt dates, 1 of which is no longer working for the company).

So u r saying that u application has been approved from Local office SESA and its now in DOL office in Phil. Well then u r so lucky becuase our other friends on this forum are still waiting from SESA.

Sorry for the confusion!

My application has not been cleared yet! I am still waiting on it to be cleared. My understanding is that they are still processing May 2001 for VA RIR cases.

...and hopefully mine with a receipt date of June 22 2001 will be processed within the next month or two!

I-140/485

Hi Guys,
Did any of you get a chance to talk to ur law office regarding I40/485. Any good/bad effect for us. I know it looks great to have two step in one time to redeuce time, esp when we are waiting for our LC more than a year and have to wait couple more months to get done our Labour.

VA labor???

Hai Guys,
Even I am waiting on my labor. but it is far away.in Jan 2002.
I am hoping recently DOL could cler more than 17000 aplication quickly and now they might clear all our pending applications within a month's time...
Do u think that this is just a dream
Pls , let em know, any body cleared their labor having PD in June 2001???
just to know how fast DOL is...
Anybody knows, the number of applications pending in DOL in RIR till now?
