Any updates from VA SESA? Can someone tell how long it's taking this days to get cleared from the philly DOL? Thanks in advance.

Hi Doldelay

please ask them what date they are processing for RIR and NON RIR while getting the status on your case. I am sure that your's must have been transferred already to Fed DOL. All the best

Case sent to Philadelphia Regional DOL , Oct 2nd 2002. The Lawyers were sent Deficiency of Evidence Notice end of september, which they replied back to with company recruiting effort details, this resulted in some delay.

According to the lawyers there are more chances of getting this notice for EB3 candidates, but if the evidence is ready, VA SESA, processes the case quickly and sends it over.

Can any one explain hat what is diffrence between EB2 and EB3 regarding Edu and Experince base.

Well, if you have a Master's Degree your application is eligible for EB2 category, with BS
Degree you are eligible for EB3 category. But if your company at the time of filling labor petition says in their job requirement that a BS degree with 6 years of experience is equivalent to Master’s degree,
then you are eligible for EB2 category i.e your application can be filed in EB2 category..


Now, other big difference in EB2 and EB3 is – right now none, coz for both category of petitions the priority dates (you need to have a current priority date before you can file for change of status) are current.

Sometime back they had this problem where EB2 was current but the EB3 had a backlog over 2 years. I hope I made it very clear in case you need more information let me know.
 
Please add me to the list , My priority date is Sep 24th 2001. Called Richmond office , was told now processing first part of Aug, not sure of the exact date. anybody has any updates.:)

Can we remove the names of some of the older people who have moved on to Philly DOL. To keep the list managable.

Update

Called Richmond office. The person was very nice and gave answers to all my questions.

RIR - 7th Aug 2001
Non-RIR - 26th April 2001

He said there are lot of applications for the month of August and September 2001.

Since mine is Oct 2001, I asked him how many months does it take to clear it. He said about 3 months or less.

Regarding Non-RIR he said it will take more than 4 months to complete April 2001 because the maximum number they received was on 30th April.
