Very Urgent Please Help..h1 to h4

I came to US on H4. In 2006 I applied for H1 and got approved which was effective from Oct 1 2006. I could not find any work on H1. Now I want to go back to H4. How can I do that? I am not sure whether I am out of status or still on H1? If I am out of status right now can I apply for H4 while in US? What is the other alternative to go back on H4? What all documents I need to file for my new H4?


It’s very urgent. I will appreciate your reply. Please help me.
 
When your H1 is approved and your status became H1 after 1 Oct 2006.

Staying in H1 without paystub means, you lost your status.

Previously H1 to H4, no pay stub is required. But recently USCIS asking for pay stub even to change h1 to h4 to verify that you are in (job) status in H1.

If you have H4 visa stamp in your pp is still valid, you can go out and come back with H4.

How can I travel with the old H4 visa? I mean when my h1 got approved my H4 was cancelled right?

------------------your status from H4 to H1 was changed. dont mix Visa stamp with Status. Visa stamp is under DOS and Petition approval is under USCIS. why not to post your full details.

you did not provide full details of your entry to US .
you came on H4 and got I-94 with H4 status and then you filed H4 to H1 Change of status in US and got H1 approval with I-94 attached (lower right side of H1 approval notice) then you did not work on H1, or got any payment on H1 status and you became out of status on H1. if you file H1 to H4 Change of status your petition may be denied. better is to go out of US and then enter on H4 status(if your spouse is on H1 status)(
 
H1 to H4 conversion

Hi Cool 2006, did u convert to h4 from h1? what are the documents needed and do we need paystubs to convert from h1 to h4? can we file for change of status from h1 to h4 without a lawyer? PLease provide me all those information. I am planning to convert from h1 to h4.
