I am a male naturalized US citizen of Indian origin marrying a woman Indian Citizen. The wedding is to take place in India in April 2012. I am looking for the quickest option for her to be in the US with me. We might have missed the K1 fiancee visa boat. I am considering a K3 but am told that now K3 visas have the same processing time as I-130, the petition for an Alien Relative and are not even processed anymore because expediting I-130 process was the sole purpose of a K3

I am more than concerned about leaving the whole process at the merci of the consulates who can be inconsiderate..

Any ideas would be appreciated.

Thanks

If you file I 130, after the wedding, it will take 3-4mts for it to be apporved, from there it should take 3mts, for the final nterview at the counsilate in india. so you are looking about 6-7mts time. Does she have any kind of US Visa now?

Thanks for the response bigbull. She doesn't have any kind of US visa and hasn't been to the US.. I am concerned about sending her to the consulate alone.. Those guys can have attitudes. What do you think about K3.. Any personal experience with a similar situation?

K1 would be the quickest way, 2-4 months. But if you're determined to have the wedding in India that won't work. K3 doesn't make sense either because it takes about the same time as going directly for the immigrant visa with an I-130. So that leaves you with the regular I-130 route which you can expect to take 6-12 months end to end.

Marrying with GC in US

I am a female who is traveling US on Visitor Visa and planning to marry a male on GC in US.

Few of Questions:
1. Can I legally stay in US
2. Can I legally work in US
3. What paper should I do to stay in US.

Any idea about my legal status in US.
