We are INDIAN PARENTS that have a US born child who we obtained indian passport and is a indian citizen last yr. However, we changed our mind this year and want to apply for his US passport.

1. Once his US passport comes, can we travel to india on indian passport and come back on US passport? We know we need to surrender his indian passport but we need to urgently travel to india, so we do not have time to surrender (which takes weeks) and then apply for PIO (another few weeks). Please let us know CAN WE SURRENDER INDIAN PASSPORT AT THE IMMIGRATION IN INDIA?

Please let us know the fastest way to do this?

You have posted several questions on this subject in OCI forum.

To answer your question here, no. India does not have dual citizenship. Once you get US passport for your kid, Indian citizenship is automatically cancelled/surrendered. If you are caught with your attempt to maintain both passports (in essence both citizenships), which is against law; you are putting your kid as well as your self at risk of long legal battle with both governments.

If you finally decide to get your kid US citizenship; surrender Indian citizenship, and get entry visa for kid. this will allow you to travel to India in near/immediate future. If you live near any of Indian consulate, you can get emergency visa (not sure of surrender certificate process, please check consulate web site) same day.

If you plan to move to India (as your earlier posts on OCI forum suggested); get OCI for all and then move. one cannot have cake and eat it too. So stop messing with laws of both countries.
 
Your your child his US passport. It is against India law to do what you are proposing to do, use his India passport to enter India, upon leaving use his US passport. Once you are detained in India, unless you have lot of money to bribe people (a friend tells me), you are going to be in serious trouble. Apply for an emergency via for your son's India trip, Indian Embassy in DC issues emergency visas, the issues is whether you can get his US passport asap.
 
How can people be so greedy by attempting to step on two boats with one foot? Where does your allegiance stand (i know the kid can't answer this question)?
 
The issue here is not about an individual holding multiple citizenships. The issue is, India does not allow its citizens to hold another citizenship.
