Urgent n-400 application irs question

I had an IRS audit (for 2005 and 2006) pending as of the date I filed my N-400 application (September 2010).
In part 10 (question 5) of the n-400 application, the question asked if I owed any federal state of local taxes that were overdue, and I answered NO because the audit was not not finalized as of september 2010 when I filed my N-400 application.

I however received an invoice from the IRS on the 11th of december stating the balance I now owe for 2005 and 2006 tax years.

My question is do I need to take these IRS invoices in for my interview (scheduled for Jan 2010) and explain to the officer that I did not have the final invoice from IRS as of september 2010 ?

I wouldn't want to be guilty of lying on my application - Somebody please advise on how this might impact my interview

Yes, you can bring that documentation and show if you have already paid or have some payment plan worked out. That will be enough.
 
Thanks BigJoe5 for your prompt response - They claim to have put some documents in the mail that will reflect initial payment and payment plan - Hopefully I'll receive these documents before my interview in first week of January.

You have to show some initiative, call the IRS and ask them to send you an invoice showing how much you own them. Just waiting for them won't cut it, and you should immediately set-up a payment plan with IRS, which you should take with you to USCIS during your interview. If you don't have a payment plan, USCIS is going to postpone your case until you show proof that you either payed or are on a payment plan. No payment plan, problems for you and delay of your case.

I made the initial payment today and have the receipts to show (via email) - In addition, I got the IRS to mail out the payment plan today and hope to receive it before the interview (First Payments is not due until February which is after my interview).
If I do not receive the payment plan docs by the 27th of this month then I'll call back and request it to be expedited (faxed,email or fedex even if it means paying for the service).

Great!!! At your interview, you will amend your answer on the tax issue and provide proof to USICS that you paid what you owe and have a payment plan. If possible, even though your payment plan doesn't require 1st payment till February 2011, it won't be a bad strategy to send them some money ahead of the scheduled 1st payment, which will show USCIS that you are on the right track to settle your debt. IRS is usually good at mailing such docs, but receiving documentation via fax is a good idea as well. In the madness of mailing, it is possible your docs might be delayed by large volume of mail which is in season. When is your N400 interview scheduled?

I already made a payment of $11,700 out of $30,000 owed - which I believe is considered first payment and the next payment is not due until february. Called IRS this evening and spoke to a nice gentleman who was keen to help once I said "Naturalization". He faxed me the document with an IRS cover sheet which I'll take with me.

One final question....

Are the officers able to correct the choice you made on the application during the interview if you have proof or are they going to request further review based on any changes?

This is great!! If you already paid some money, that's positive step towards a better resolution of your taxes. The IO correct the forms by themselves, so as long as you have the documentation, the IO will makes all the notes. In some cases, they might give you a decision cannot be made letter, so that they can review your cases and all documentation, and this usually increase the stress level of most people. Don't be alarmed if they give you a decision cannot be made, because at tome point, a decision will have to be made. Hope this helps.

In your experience in this forums (Since I see your name in a million posts :) ) , do you think this is grounds for delay or denial? I'm trying to stay optimistic but I'm super Nervous

If you haVE PROPER DOCUMENTATION, THERE WILL NOT BE A PROBLEM.Most of teh time they do not even ask about taxex at all.

if you have reached an agreement with the IRS about your unpaid taxes and you have the proper documentation to prove it. you should be ok. two of my friends haven't been asked for taxes return documents.

Just bring the IRS letter to interview.You'll be fine unless you previous withheld this information from USCIS.

I did not withhold information from the USCIS - The fact is that I was undergoing an Audit as of the date when I sent in my N400 application (Sept 2010) - The decision was not made yet by the IRS until a few weeks ago (Dec 2010) when they sent me an invoice - So technically, I did not owe in september when my CPA was in dispute/liason with the IRS negotiator.
The two related questions were:
1. If I ever failed to file taxes" which the answer is NO.
2. If I owe the IRS - The asnwer was NO as of September.

Now, do I need to bring that to my interviewers attention? I have all the documents as I earlier stated to prove this.
 
At the interview you are required to update the IO of any changes to the questions on the N-400. If you now owe money to the IRS, then the answer would now be YES. Again, present the IRS letter at interview and you'll be fine.

This is to express my appreciation for the nice and assuring input and answers to all my questions on this forum.
I was an Asylee and now have my approval and Oath letter in hand despite the fears the IRS engraved in my heart.
The IO had the nicest personality and even though I brought the IRS audit to his Attention (as advised), he acknowledged and appreciated that I made partial payment and a payment arrrangement .
Now I just have to attend the oath and then apply for passport.
