URGENT!!! Is this scenario possible for 7th year Extension

My H1B expires on Jan 2006. I am currently working with company A. I have filed my labor for Green Crad from company B early Jan 2005. But I haven't started working for compny B yet. Now if I join company C, can company C file my 7th year extension based on the labor filed by company B.

I would really appreciate any inputs on this.

------------------ your LC filed by B Jan,2005, you are not eligible to file 7th year H1 extension at this time as your LC is not pending more than 365 days once it hits 365 days and you have evidence of LC filing more than 365 days then C or D can file 7th year H1 ext but you may have to start the GC process again ( but you will lose the early PD of LC filed by B if I-140 for you is not filed by B after LC gets approved and I-140 is not approved) PD is going to play IMP role in getting GC in coming years for India, China born
But I haven't started working for compny B yet.

My H1B expires on Jan 30th 2006.
Labor for GC filed by company B on Jan 2nd 2005.
Why am I not be eligible for the 7th year extension even though I filed my labor one year prior to H1B extension????

You can file for 7th year extension on or after Jan 3rd 2006. Since your H1B expires on Jan 30th 2006, you will get a receipt notice of your H1B extension petition. That petition alone will let you work until the decision is make. The limit you can work is I think 240 days from the received date.

In order to be eligible for the 7th year extension, your Labor should be pending for more than 365 days.
