Do u have a criminal background which can tank your application? I would be more concerned if I had a criminal background...

Be careful what old enemies cann do when you least expect...

hi friends,
thank you very much, i dont have any criminal background but there was some incidents where my name was falsely added but there is no police complaint against me. hence i want to know that:
i) do the USICS work according to their criteria only? means if anyone dont have any records then noone can stop them to migrate to usa?
ii) if they take the info. provided by the others seriously then will i have a chance to appeal?
iii) DO THEY TAKE THE INFORMATION PROVIDED BY THE ANNONYMOUS SERIOUSLY I.E. SEND INFORMATION BY THE EMAILS.

hence dear friends the above points which affect me so pls. pls. give exact advise on the above.

USCIS operates under laws passed by Congress. You'll have to fulfill any number of criteria to be eligible for a green card ... having a clean criminal history is one of them. However, you're never guaranteed admission to the US, even if you fulfill all criteria.

They might not accept anonymous information as credible proof, but nothing stops them from further investigating and finding credible proof based on the information provided.

It would be a good idea for you to try to get your incorrectly added name off the criminal records.

dear friends,
thanks thanks a lot for your valuable guidance and help.
one more and last thing i want to ask you is:
  • WILL THE USCIS inform me that the xxx person have complaint against you and WILL THE USCIS give me any opportunity to clarify it i.e. right of appeal?
dear friends i am very thankful to you. pls. answer me on above.

I believe one have to get police clearance in the state or country of residence. If police clearance doesn't hold any criminal record, then one is safe. If any third person is saying Mr X is involved in this illegal activity and provide some proof..........then situation is different. I think any administrative procedure is not dependent on rumors......... You can wait and they will let you know how things are moving. Try to gather evidence your history is clean.

dear friends,
thanks a lot for your help and replies. however i am still waiting for your answer for the following;

  • WILL THE USCIS inform me that the xxx person have complaint against you and WILL THE USCIS give me any opportunity to clarify it i.e. right of appeal?

dear friends pls. pls. share your valuable experience on the above and pls. guide me. thanks.

Are you adjusting status in the US or applying for CP at a consulate? I believe your right to appeal are different under both cases. At a consulate, you're actually dealing with the Department of State, not USCIS.
