Urgent Help Needed - Interim EAD

I am in a very tough situation right now and I am hoping that you folks can help me guide in the right direction.
I applied for my EAD renewal on July 13th. ND July 14th. I also got a notice in Sept that my EAD application has been transfered to Milwaukee sub office as my 485 case was also transfered there in Nov 2004.
I went to the milwaukee office today as I did not get my EAD yet and it was more than 90 days. My current EAD expires on 10/25/05.
The infopass lady said that they dont give urgent/same day EADs and took the new applicaion from me and said that I should get a green appointment letter from them soon and then I can come and get my EAD. These appointments are only on Wednesdays. She said I might get an appointment for next Wedneday (day after my EAD expires)
I am very worried that if I dont get the EAD on time I might lose my job. The info pass lady also mentioned that the only way to get sameday EAD is to show a proof that you will lose your job or something urgent. I have a few questions...
1- Should I wait and see if I get the appointment letter on time?
2- Would it count against me if I get my new EAD on 10/26/05 while the old expires a day earlier?
3- Is it possible to switch to H1 or something?
4- I am not sure what to ask my company to give as proof of urgencny??

Your help is greatly appreciated :confused:
 
Letter from the employer that you will lose your job if you do not get your EAD. Yes it is a big deal if you work without EAD for a day or without valid authorization, try and avoid it. Not possble to switch to H1. Strong letter from the employer and begging with the USCIS are the only options I can think of.
 
The earliest appointment I could get through Infopass is for next week Tuesday Nov 1st. This is six days after my card expiration. Unfortunatly the milwaukee office does not accept ANY walk ins and I do not know what to do.
Do I have to ask my employer to take me off the payroll or can I just take vacation time for the interim?
How do I prove to CIS later on that I did not work during the EAD gap?
Is the new EAD card back dated to the expiry date of the last one?

Very stressed and on a verge of a breakdown :(

If you work >180 days without work authorization, penalties (3 yr bar) kick in. No penalties for working <180 days.
 
Out of status less than 180days cause no penalty, but I do not know working illegally less than 180 days is OK.
I do not recommend to knowingly work iillegal.
 
The company would also be subject to fines and sanctions if it were caught employing you without work authorization.

I have stopped working from today as my EAD is expired. I have an info pass appointment for next week Tuesday. IS there any reason that I will not get iEAD at that point?
The original application has been pending for 100+ days now. Last week when I went to the local office they asked me to fill another I765 form which i did. I was tols I should wait for a letter in mail to come again and get the card OR get an urgent letter from employer.
I have the letter from employer now also. Is there anything else they can do to screw me up...should I be ready for any other excuse from CIS to not give me iEAD next week?

245k covers out of status and illegal employment. The only thing to keep in mind that this is an aggregate limit; if you were out of status for 90 days before you filed your I-485, you have only another 90 days left.

The 3/10 year bars do NOT kick on for illegal employment or out of status periods exceeding 180 days. They are only invoked based on ILLEGAL PRESENCE, which is a totally different animal (generally speaking, overstaying an I-94).

If you have illegal employment for >180 days, then you are ineligible for 245k relief and must obtain an immigrant visa from a consulate.
 
Well...good news is that I got my interim EAD for 8 months yesterday. My old card was expiring on Oct 25th and I got this interim card on Oct 26th. Close call !!
Once I was able to get the infopass appointment and showed them the "emergency" letter from employer that I will be fired if I dont get the card, they were very quick and responsive. The whole process took about hour and a half.
What a relief...looking forward to enjoying the weekend now.
