Urgent Help :Got some certified mail from Immigration

Is it better to wait till I complete 5 yrs. Now I have around 1080 days
You have 1080 days of physical presence in the US in the last 5 year (counting back 5 years from August 2010)?
Also, you also need 5 years of continuous residence. What residency ties did you have in the period of 2005-2007 when you spent the majority of your time outside the US?

I would reread the requirements for physical presence and continuous residence if you think you meet them, reapply, or reapply as soon as you meet them. For continuous residence there is a rule of 4 years and 1 day (I believe) after your last trip that broke continuous residence. So, in the worst case you don't need to wait full five years. No need to wait longer than you need, apply as soon as you meet the requirements and realize that you have to meet the requirements all the way through oath ceremony, so you might want to have some buffer on physical and continuous residence just in case you have to travel during your naturalization process.

They mentioned that I was outside for 915 days out of 1826 days.

They mentioned 915 days, or did they mention missing the mark by 2 days? I suspect they said 915 ... the other is your assumption. Please do not file when you can be rejected by 2 days here or there, and have a good cushion (of presence).

USCIS did the right thing, you didn't meet the requirements. You need to observe all the laws as other future citizens do, as opposed to live in India and expect USCIS to honor you with US citizenship. You even had the gall to travel to India while your case was pending, what a man....lol!!! I mean, if you didn't show the ballz of steel to the IO by asking him such a ridiculous question, then I don't know what more other reason USCIS needed to give you. USCIS has guidelines which people ought to observe, but you didn't and you should start from scratch and calculate how you plan to meet the physical presence test and residence requirements. Rarely does USCIS send certified mail, but they wanted to clearly nail you azz on the wall....lol!!

Here is an example of what I am talking about...You need to put a lock on your keyboard if you dont have any good advise

Sorry to hear your application was denied.

Can you provide the exact dates you were out? Just to see how CIS calculates time spent outside the country...

It is your prerogative to give people hope on hopeless cases, who can stop you. It is my view that people ought to be given the blunt truth about their case, NOT what they hope to hear. The OP was given wrong advise by a lawyer on the merits of his case, and he paid the ultimate price. I could have evaluated his case without charging him a fee and told him, wait till next year but cut your travel escapades. USCIS would care less about someone applying based on hope, I am yet to see "hope" as one of the requirements for naturalization, but physical presence and residency requirements, paid taxes and moral character are still being used to evaluate candidates, so just continue with your "hopey-dopey" advise. Unless you are suffering from imcomprehension, maybe you should re-read my post on the OP. I clearly told him he need to observe laws as set out by US Congress for people intending to be US citizen, but I know reading and working to meet those requirements isn't "hopey" enough for you.
