Urgent Help :Got some certified mail from Immigration

Hi,

I need help ASAP. I attended for citizenship interview on 23-Apr-2010 and decision was pending all these days. In the last 5 yrs I spent 913 days out of the country , and the IO kept my case in pending.
2 weeks back I came on vacation to India after checking with the IO that there will be no issue if I travel outside the country . I gave my mail box key to my neighbor. Today my neighbor called me and told that there is a certified mail from Immigration. I need to pick that one before Aug 7th 2010. I will be travelling back around 12-Aug.

I am really worried what would be in that letter. Does INS send Oath confirmation or rejection by Certfied mail. My online case status still shows that "Interview and decision pending"

Any help will be really appreciated

Don't want to get you worried but any request for additional evidence or information or Oath never comes certified, let's hope everything is Ok.
 
I have never seen anything certified before from USCIS. Hmmm maybe they want you to appear for another interview shortly that is why they are sending it certified. Not sure.

I am here to give people hope in their cases...Look at it this way...get your continuous residency in order and we can always reapply using the four year and one rule...Good luck to you

Is that 913 days outside the US at the time you applied? If so, it's very close to (if not over) cut-off for physical presence requirement of 912.5 days (5x365)/2). The IO needed more time to calculate your physical presence in order to make a decision in your case. Being so close to the limit, there's a good chance USCIS will deny your application for not meeting physical presence requirement.
 
You can send a fax (letter) to your neighbor authorizing him to pick up the letter from post office and OPEN it and see what's inside.

It could not be oath letter as its not sent in certified email.
May be its not denial letter as well. IO may want additional proof from you to prove your physical requirement like recent tax papers, utility bills, passport copy of all pages etc.

FYI, I am just guessing all this.

Physical presence is verified via CBP entry/exit records. Utility bills and tax records are not supporting evidence for physical presence.
 
Thanks for all the replies friends. I faxed an authorization to my neighbor to pick the mail. Let us see what happens. I applied after 913 days. But I was here in US continueously with out leaving for the last 30 months. Need all prayers from you all

You applied 913 days after what? The issue here is your physical presence. Moreover, if you were in US continuously for last 30 months but were out of US 913 days in last 5 years it means you have broken continuous residency as well in the last 5 years. All the prayers in the world can't help you if you haven't met both physical presence and continuous residency requirements.

I never broke the 6 months period and was getting into country for every 4 or 5 months. From Sept 2007 I did not leave the country at all

Back to back trips under 6 months can be seen as a sign that you have presumed to broken continuous residency during the statutory period.

It's 365 x 5 + 1 day for the leap day that definitely falls within the 5 years, so 913 is exactly half. I read this somewhere. Anyway, yes, please tell us what your letter says.

Still, borderline physical presence for the OP. Combined with the fact that OP was outside the US the majority of the time between 2005-2007 (regardless if he returned to US every 4-5 months for a day or so) is a strong indication that his case will be denied.
 
Today I am back in the country and found that my casde was rejected. They mentioned that I was outside for 915 days out of 1826 days. I missed the mark by 2 days it seems. But they mentioned that I can reapply once I meet the 30 month period.
Please advise what do I do now

USCIS did the right thing, you didn't meet the requirements. You need to observe all the laws as other future citizens do, as opposed to live in India and expect USCIS to honor you with US citizenship. You even had the gall to travel to India while your case was pending, what a man....lol!!! I mean, if you didn't show the ballz of steel to the IO by asking him such a ridiculous question, then I don't know what more other reason USCIS needed to give you. USCIS has guidelines which people ought to observe, but you didn't and you should start from scratch and calculate how you plan to meet the physical presence test and residence requirements. Rarely does USCIS send certified mail, but they wanted to clearly nail you azz on the wall....lol!!
 
My trip to India was a business trip and before booking the tickets I asked the Io is it ok to travel. After they said yes only I travelled.
