Updates:Did you file your 140&485 before Sept 30th 2005 retro deadline?

I140/485/765/131 sent through DHL on 09/29/05 and reached Saint Albans, VT on 09/30/05 at 10:00 AM.
Labor EB2 (Substitute)
Anybody got the receipt notices from Saint Albans, VT?
And what is the difference between District Office and Service Center?

I-485 filed Sep end..RD Sep.05 - Notice Date in October 05

I understand that cases (I-485 + I-140) filed late in September are getting Receipt Dates in October 05..and such cases will be "held in abeyance" by USCIS. Is this true? Does anyone have any information on this?

I am also in the same boat as you. Lawyer sent my 140 and 485 on 09/29/05 and reached VSC on 09/30/05. No news of receipts yet Checks not cashed yet.

Please post here if you receive your receipt or your checks get cashed.

I am in the same boat. Sent St.Albans on 28th and they received on 29th. Checks are not yet cashed and no receipts. Waiting on them.

Guys please post any approvals done in these two days. That way we can know whats going on.

Does it mean they won't be considered for I-485 processing ? :eek:

For 485, the Priority date will continue to determine their processing. 140 shall continue to be processed and 485 shall have to wait for the PD to become current. EAD and AP shall be granted.
 
Texas Service Center?

Anybody goes to the Texas Service Center? :confused:

My 140/485 were received by TSC on 9/29/05. Checks were cashed on 10/4. I got all SRC# case numbers from the check images of my bank. I checked the case numbers online and it says that they were received on 9/30/05 and receipts were sent out. The LUD is 10/4.

However, up to now I haven't received any receipt. I heard that serveral people filed around 9/29 have gotten their receipts last week. I am a little anxious.

Should I be fine if I can see the SRC# on the checks? Some check images are not so clear and I am not 100% sure that the numbers are correct. Can I call USCIS to verify those numbers now, or I have to wait for one month?

It looks very few people here go to TSC.

Yes, I know. My attorney should, and will notify me as soon as she receives them. But she hasn't received them.

This is a great news, like you there are so many filed before the deadline. Hope fully every one will receive their receipts in another couple of days.
In your case looks like you cut your own checks for 140/485/130 fees.

In my case my attorney paid on behalf of me. So he would only know whether checks are cashed or receipts received or not.

Who told you this? If this is true, we are again screwed. My application reached VSC on September 30th. I've not received any receipts.

Please people, can someone comfirm this? If it is true that the receipt dates for late september is going to be in october then what was the point of all the last minute running around. My PERM was approved on September 28th and I sent I-140/EAD/AP/I-485 on September 29th and it reached on September 30th.

Please advise..

That's why somebody suggested me that I should use my own checks. I think your attorney should write a check for each of your forms. So if the checks are cashed, he should be able to check them online and find the case numbers on their backs. Ask your attorney and see if he can do so to get your case numbers.

Filed late Sep; RD-Sep; ND-October

Well... I filed my I-485+I-140 in the last week of Sep at VSC.
Got my Receipt notice this week...while the RD is Sep; the ND says Oct. 05.
....and of course, there was no "Priority Date" on the notice
My lawyer says that any of the following is likely to happen...

1. USCIS could return my application at a later date...(This though, she says, is less likely as they have cashed my checks etc.)
2. USCIS could have my I-485 "held in abeyance" since (technically) no visa numbers were available...in which case they would notify me in the very near future.
3. If my I-140 gets approved, when it's time to process my I-485, they could just say that no visa numbers were available for this PD, I'd need to wait till the PD becomes current sometime in the future.

Of these, (3) is a bit helpful as it allows one to take advantage of EAD, AP etc., and gives time for one to sit and pray and repent for earlier sins :(

It would be good if others can throw more light on similar cases.

For 1, if your RD on your receipt is Sep, they could only RFE, approve or deny your application. There is no reason that they return your application.

For 2, 3, they will just hold your 485, and won't bother to send you a notice that there is no visa number; you can see by yourself at the visa bulletin.

UPDATE from TSC on my case today

AP approved today - 10/13.

140/485/AP/EAD received by TSC 9/27/2005 for EB2-RIR.

All others application still pending with same old LUD of 9/30.
 
no one received any response from any USCIS

Hi all,

After reading different forums (to my knowledge) no one received any response from any USCIS for those mailed their petition on 09/29/2005 and reached USCIS on 09/30/2005.

Therfore all are (for that particular mailing date)in same situation. When I called NSC, They can not answer regarding this and asked me to check back around october 30th if I dont get any response.
