How come? Your PD is 10/2002 , right?

Out of curiosity I just checked the status of my I-140 online and it had an LUD in 07/22/07... thats very odd since it was approved in '05.
Anyone else with a similar LUD? what can this mean? is it even significant?

Finally, we got approved and cards have been ordered. For the people who is still waiting don't loose your faith. It takes time and sometimes it is very painful to see that our lives depends on others, but eventually is over.

Our EB3 case was from april 2001 in Texas. The labor and immigration departments made so many mistakes with our case and that delay so much our case.

Thanks to everyone who share their stories in this space, it was very helpful to read all your cases. Good luck to all of you, I hope you get approved very soon.

I just called the TSC about two things:

1. my second RFE (issued on oct. 3rd) which neither my attorney nor I ever received. The lady who answered the phone was actually very angry and rude, she said that she is not going to give me any information about that and I have to ask my attorney to inquire! My attorney inquired about this 45 days ago and has not received anything yet!

2. I told her that my name check has been pending for more than four years now. She said that they don't have anything to do with FBI!!! I was like, "what do you mean you don't have anything to do with FBI" and she said, I told you sir, we don't have anyting to do with FBI and whatever information FBI has give to you, you have to hold it for yourself! then she hung up after I said OK.

Anyway, I don't understand how anyone can justify a 4 yrs of wait for a name check, unless the FBI is requesting more information from your home country and your government is not cooperating. I've heard that before. Maybe you should try to contact someone in your country's foreign ministry and try to find out if thats the case with you.
is WOM still an option? I've read in another thread that they are working on putting an end to that option too. Recently some people were denied to even file a claim. Is that true?

WOM is still an option, and the best one who wait over 2 years

The USCIS is not going to automatically expedite your case if you filed WoM. They will ask attorney to motion to dismiss, but depending where you file your case, I'd say you have a much better chance to beat the MTD.

From what I have read recently, if you live in east or west coast, you should go ahead and wom them, as there are very few cases got turned down. The court judge are most people with a sense of justice after all.

WOM is an option. I can't do it before I get my H1-B next Oct though. FBI does not inquire about me from my home country, I know that as a fact.
 
Must be a non US ally country, very much like myself. At least I know that wont be an issue in my case.

Being an ally country doesn't exempt you from at-home security checks. If anything, they can get your records more easily from, say, a NATO country than, say, Russia. I remember someone mentioning her husband was arrested in Italy, which was incorrect, but just goes on to show that criminal records are more readily exchanged between friendly nations.

Of course, if you have no record, you have nothing to fear..

well they promissed to clear 40% of pending name checks by the end of 2007. I bet they will clear all those name who are affected by visa number.

I hope that is true. A friend of mine who applied for citizenship in 2003 and got stuck in name check, filed WOM recently. After the judge ordered the USCIS to clear his case, his name check which was pending for more than four years, was done it in two weeks! so, this name check can be done quickly, but for some reason, they don't want to do it. :(

Wish it was that easy. Unfortunately, even people with no record whatsoever, anywhere, will still get stuck in NAME CHECK. It's completely random.

With NAME CHECK, the defendant is presumed guilty until proven innocent, and even when proven innocent they may hold you up just for the fun of it!

Congrats! First, no one is losing faith, and what's the worst that can happen if some one does. Winners find their way wherever they are. Second, what good is your post if the details are not there.

2nd LUD send only to the lawyer (October 9, 2007): The IO states that we have filed our 485 on August 26, 2006 because the approval date of the I-140. (This was erroneous). Our original filling was on April 23, 2001 but they approved with the second filling and never corrected the date. The IO suggested to request the Labor Department to change the priority date (We asked this before but no answer). IO states if no correction is made we will not eligible for adjustment status based on the 245(i).

My lawyer replied October 17, 2007
LUD October 19, 2007 (information was received).
CHRIS mail December 12, 2007 acceptance
Chris mail December 13, cards has been ordered.

My husband is the main applicant. He is Turkish, and I am Ecuadorian.

I got my GC in October 2007, and 6 weeks later, I got LUD on 140 (on 11/25/07). I-140 LUDs are very common and may not be specific.

I guess other folks got LUD on I-140 during summer time, but I got one yesterday(12/15), though it was approved in early 2005. I was expecting a LUD on I-485.

Priority date: Aug 2004,
I-485 RFE - 60 days completed
 
USCIS approving case who filed on Jun 2007. Some of my friends got GC whose priority date is way behind and I am stuck since 2002..I feel very unlucky myself and now not sure how many more years it will take. Kids are young now and they can not adjust with the Indian education if we decide to leave this country...so worried about kids otherwise no point
