Good news

I believe it takes at least 3 weeks for USCIS to update its records regarding the Namecheck completion.

This really gives me hope. I am in the same boat. I worte a letter to First Lady in May 2007 and just received a letter from FBI that my name is in Process. Hopefully, that means really.. in process :D

Hi Guys,

I have a weird experience and would like to share maybe somebody can help me. I received approval notices for I-485 for both me and my wife. Got Green Card for self but nothing for spouse. Called USCIS and was able to talk to a person, she told us that my wife's biometrics are missing and that they sent us a notice for biometrics on the 19th. Now we already had our biometrics taken on March 19 and have completed all the necessary steps and have a stamped copy. She said that the system does not show her picture, we told her that she got EAD card which shows her picture. It was all very weird as to what is missing and what is not. Neither us or our lawyer have received another notice to appear for finger printing. Not really sure what is going on. Any ideas, help and suggestions?

Does anybody get a reply to official inquiries from the USCIS?

I made a couple of inquiries with the National Customer Service center more than 3 weeks ago but have yet to hear anything or see any movement on my cases. The first inquiry I made was when they published the wrong processing dates - remember when the fiascos were small, like moving the I-485 processing dates to March :)

So I used that one day as an opportunity to make an inquiry which they allowed. My next inquiry was on my I-140. Even though they mentioned that I am not the applicant who should be making the inquiry, my company is, I guess someone took pity on my seeing that I am soon going to enter my 9th month in that application and filed an inquiry.

No word on either inquiry yet.

As my signature shows, I made an inquiry thru my district congresswoman in Feb. and since I did not hear anything from them after more than two month, I asked for an official inquiry thru the national customer service center in April. Neither of them have been replied yet. I basically don't know what else I can do besides renewing my EAD and AP before the end of this year when they increase the application fees :d.

They lose stuff. So it is a waste of time and effort trying to explain it, they won't bother to dig them out either. So if it were me I'd just call them again and ask them to send in another FP notice, in case the first one sent on the 19th got lost in the mail. Then go to the appointment and just wait for the card to show up. Make sure you don't miss the appointment and have another round of hassle; so I would ask what the date was as stated in the original notice and either reschedule it or inquire whether you can go without the notice. whether old PD will be retained?

I remeber earlier discussion in his forum regarding this topic. As I recall, at the time of issuing receipt, USCIS does not look closely at your application due to various substitution regulation and it is standard practice that PD is left blank in the receipt notice. This is doen for every applicant. Same is true for I-140 receipt notice. However, when I-140 approval notice is sent, the priority date will be filled.

That means my old ported priority date will be retained?. That is Dec 2000? Any update / info is appreciable.

Send suggestion to the CIS Ombudsman

Some of the people in this forum and I myself, asked the CIS Ombudsman a few month ago to suggest a premium processing service for the FBI namecheck. I am going to pay about $300 for renewing EAD and AP and those who are going to renew after the end of this month should pay ~$600. In any case, many people have to renew EAD and AP at least once which means paying $600 in application fees. In the mean time, everybody is anxious when his/her greencard application will be approved. If they implement the premium processing service with gauranteed 6 month processing (adjudication+ namecheck clearance ...), applicants pay roughly the same money but they get approved in time, the backlogs will be removed after a while and everybody will be happy. Since a lot of people pay that money any way, why should it be used for a better cause which is clearing our namecheck instead of renewing EAD and AP!

I would like to ask all of the people who visit this thread to send an email to the CIS Ombudsman (www.dhs.gov/cisombudsman) to suggest this, if you agree with me.

Did they give you a case number when you made the inquiry. I got one for my I-485 request but forgot to take one down for the I-140 request (silly me). They said that if I don't hear anything for 45 days, then I can use that case number as a reference and call back. If you got one, you should definitely call them back. Even if you haven't, it doesn't hurt to ask and let them know that you lost the case number - they should be able to find you via other means, e.g. your A#.

It happened with my spouse's name. I called up customer service number and opened a case. Few days later I got a response explaning the correction.

Yeah, they gave me a case number. I should call them, although I know they will submit another useless official inquiry. I should probably make an Inforpass appointment this time.

We called again when they moved the dates to MArch for one day. My wife's was clear, the lady over the phone (very nice by the way) told me that my security check is still pending and I should wait for another 60 days. I know when you don't get a response its frustrating, but sometimes getting one doesn't really help much either. In the case of our EAD and AP both times they were way past the dates and only after I called they got approved, so makes me feel that at least someone opens the file and takes a look inside.

My attorney made a query and didn't get response within 45 days. Then made another one and got reply for that within 20 days. After a few days the response to first query came !. So, the first one took 2 months.

That is exactly why I made the inquiries. I just want someone to open my case files. It's really frustrating having an I-140 be pending for so long, and the company nor the company lawyers don't want to do anything about it or apply for premium processing. I know I'm stuck in a security check, but at least being past the I-140 will put the matter into my hands where I can ask congresspeople for help. Hopefully my inquiries went through and someone will respond.

What was the Response from USCIS ??? Lot of people who filed in July 2006 got stuck in FBI Name Check. I don't know. Why??? Please let us know.

questions regarding pending 485

I have another question regarding my 485.

I am changing employer. My 140 is approved, my 485 has been pending for 9 months. Both EAD and AP are approved. How can I go back to my home country and work in a US firm's overseas branch office and keep a valid status for my green card? The offer is from the US firm's New York office.

I appreciate your help.
 
Take care that your AP does not expire before your entry back in to United States. Failure to do so would result in abandoning of 485.

I just received the following message:

Current Status: Card production ordered.

On July 11, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you.

My wife's case is also approved today.

lud on approved I-765

There is new LUD on my previously approved I-765 which is approved already on 05/31/07 and received it 06/04/07. Why suddenly LUD on I-765? Is there any reason?
