Travelling for new I-94

Hi Senior Members (Jaxen),

My new H1 with the present company does not have I-94. I have the visa stamp and I-94 (previous) valid till sep 03.

I am planning to visit European country and get back with new I-94. I am really tense and need advice of seniors line Jaxen on what to expect at the POE.

How should I present the new approved petition to the POE officer requesting the new dates for the I-94 as per the latest petition.

Have a letter from employer (paystubs if possible) and request that the new I94 reflect the I797 approval. If the POE inspector refuses, politely request to see a supervisor. Plan for a 3-5 hour break (depending on the port of entry, traffic, the mood of the inspector and the disposition of the supervisor).
Even if you dont get the new date in I94, you can always get the new H stamp (60 days before expiry ) in the passport from St. Louis. Your only concern is now to get a new I94 with some validity date...

Update -- Got new I-94

Yesterday I returned back from my trip to European country and at the POE it all took less than 2 minutes.

I got the I-94 dates as per the latest approved I-797 when I showed the latest approval. Nothing was asked as proof by the inspector, like employment letter etc. Only one question on what job I do.

Thus ended happily in 2 minutes last 2 months worry for me.I thank Jaxen and this forum for the help I got.

Hi Jaxen

My I-94 got expired on feb 27,2003. I applied for my HIB visa revalidation in Jan 2003 to Dept of state ,St.Louis.
Unknowingly I send the I-102 for extending I-94 to Dept of state. They revalidated the HIB and issued me new HIB visa valid till Jan 2004 and just returned the I-102 form and did not return the $100 money order and no letter also.
Now I am thinking of applying I-102 to BCIS with the proof of my application send to Dept of State. I am just 2 weeks out of status ,but have a reason and proof that I tried to apply earlier when I had valid status but to wrong dept. What are the chances of getting the I-94 extension .Can some one write on this.

*** When they revalidated your Visa till jan2004 it means your H1B approval has I-94 attached till that date from INS, please check the approval notice you may find I-94 at bottom, how they can revalidate the Visa sticker if your approval notice did not have valid I-94 till Jan 2004 or I am missing some info here?
