I'm currently on F-1 but my mother has filed an I-130 for me as an unmarried daughter of a permanent resident over 21 with a priority day in March of 2001. The wait is so long and I haven't left the country since then and it appears that there will be many many more years to wait so I'm wondering do I face risk if I travel abroad on my student visa although I have the I-130 pending[/B]. The problem is that if I do I need to go to the embassy and renew my visa since it expired long time ago. Please, let me know if you have an idea as to the potential risks. Thanks.

yes, the risk is quite high. Since filing I-130 is showing immigrant intent, the consul will be compelled to refuse to give you a non-immigrant visa.

F1

Actually you are not eligible for F1 , since you got it before your I 130, you are lucky.

Best advise is , Do not go out of US. Finish your studies, get H1, or get married with a US Citizen.
