Traveling on Advance Parole (2nd time)

My Wife and I are waiting on 485 EB2. Out 485 notice date in Aug 24 2007 and the priority date Sep 15 2005. We have both traveled out of the country once and returned back on Advance Parole. We have to travel again shortly and will be applying for AP again. In this regard, I have a few questions.

I guess the only requirement along with the form is a copy of 485 and 2 passport photos which should be mailed to the below address since our 485 is being processed there,

Is there any other requirement. I dont remember what I sent in the last time.

On the instruction form for 131, it says that “if you filed form 485 on or after Jul 30 2007, and you paid the 485 fee required, then there is no fee required to file for an advance parole”. Now I just want to confirm about this. I did not see any riders attached to and our notice date for 485 is Aug 24 2007. Does that mean no fees for us? Or is it meant for a special class? I am not one of those who paid $1000+ for 485.

TSC is currently processing employment based 485 application for Aug 30 2007. We got out biometrics done last year around the same time. Do you think there is any reason we should not travel. Would they require a bio metrics appointment again? How long is fingerprinting valid for once done?

Lastly, is there a limit to the number of times one can apply for AP while waiting on 485.

Thanks. The reason I asked is that I did not get my fingerprint notice. I had to in fact take an appointment to give my biometrics.

Any idea, when they would ask for my biometrics again. Would it be close to the end of the 2 year period or close to when my case becomes current.

No consistency in that, when you are required to do it, just do.

INS will send you notice when they think they need your fingerprints.
I got my 1st fingerprint done in Aug 2007 and none after that.
 
I am sorry, just one more question.

Lets say I am traveling and both my 485 processing and Visa numbers (as announced in the Visa bulletin) becomes current, what happens then?

Request for additional finger printing is one notification they can send, but what else. The most important question is what if I am not around to respond within the time they expect me to if I am traveling.

They might approve your case, or they may let it continue to sit.

If they approve it while you're abroad, you can still return with Advance Parole or an H or L visa. At the port of entry they'll realize that you're a permanent resident, send you to secondary inspection, and process you accordingly.

If it's fingerprinting you're worried about, they can schedule an appointment for that whether your PD is current or not. So if you're traveling you need to have somebody checking your mail in case you get a fingerprint appointment.

I already have had my biometrics done once. If they send for another one and I miss it, will it be a problem to re-schedule. I have heard horror stories of people missing their FP appt in general.

Please advice.

Yes, it can be rescheduled, but if your priority date is current or close to current when you receive the notice, and you are in EB2 China or India, which are regularly subject to retrogression, you better find a way to jump on a plane and show up for the fingerprinting. Rescheduling often results in an appointment months after the original one, and during that waiting time you could see your priority date go from current to retrogressed, leaving you waiting for another year or more to become current again.

On for 131, for class of admission, can I write "Advance Parole" for my wife and I?

Should I also attach a copy of H1. I dont have an equivalent for my Wife as her H4 has expired and I did not have to renew as she is waiting for adjustment.

If you last entered with Advance Parole, you could do that. Or you could write "pending AOS" like I did.

Ultimately, I don't think it really matters, as USCIS has a record of your last entry and any recent changes of status. Some people even leave it blank but still get it approved.

Just to clarify this point: You would need to have somebody receive the notice and reschedule before the actual FP date assigned to you. If you miss the date entirely and come back to find a notice in your mailbox with the FP date already passed, then your situation becomes more complicated. You would need to designate somebody to check your mail and request a postponement of your date if your biometrics notice arrives while you're gone.
