Tracker: Waiting for Derivative's I-485 Approval

Finally, good news for my spouse.

My derivative spouse went to infopass today and was told that the GC is approved on 16th May 2008. There is no online update since January 16th 2008 (Date on which the case was transferred from TSC to NBC) although we attended derivative interview on Feb 7th(Visa unavailable), infopass on April 24th (Visa available) and the second infopass today. Also, upon asking, they stamped the passport for one year. One bad news is that, meanwhile a cop placed a parking ticket of 60$ for not having emission inspection - in PA, you must have a emission inspection sticker).

I hope 'Anyaforever' and others who are waiting for derivative GC 's visa numbers becomes avaialble and they get GC for the derivative soon.
 
Finally spouse is approved.

So, without further ado:
PD 01/2003
140/485: Nov 2004

Primary approved:June 2005

Called USCIS: July 2005, December 2005, August 2006, March 2007, June 2007
- First was told security check pending, then told (In june 2007) case assigned to officer and security check complete.

Infopass: July 2007 - Was told same info as above

SR: three SR started - don't remember the dates of first two. Usual reply "additional review needed".

Third one started on April 1st 2008. Reply came back on May 13th "application within processing time"!! Called Customer Service again and was told that application is WAY out of processing time, but I cannot start another SR until 60 days after last one (so not until June 1st 2008).

Biometrics - sometime late November 2007

LUD on 02/03/2008 on pending 485

Meantime went through several retrogression/current cycles over a period of several months. (had pretty much stopped caring about it by then, so don't remember)

April 2008 - wife finally got frustrated enough to go to congressman's office with gigantic file of immigration material.

May 15th 2008 - finally approved.

May 24th - received card.

This has been a great forum - although for many months now, I have not been an active voice. I'm just glad this is over.

I hope others see their approvals too.

However, we have to perform additional review on this case and this caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.

What does this mean? Any response/experiences similar to this case will be greatly appreciated.
 
Spouse card received yesterday 5/27/2008, 5 business days after approval date. Finally the GC journey is over, never want to board this flight again.

kazaparu, though one of the standard letters, the "additional review" might be a security check by USCIS (not FBI). Some people have received that reply, but I have no idea how long it typically takes to get approved after that letter. Ask in the 485 tracker thread, there must be someone with the same experience.

My last post was in august 2007. Finally our GC journey is over, just when we lost all hope. Thanks to everyone for all the support.

Security checks for spouse cleared - mar 2007

I've been waiting since Nov 2004. Hopefully our PD will be current in the coming months and I can have something positive to say.

Please look at my signature. My derivative date changes are matching with yours. That means there is some batch task is going on and in which our applications are pending.
But for my kids/derivatives, USCIS has never asked for finger printing so far.

Is that correct or any comment!
 
I was approved on 5th May .My spouse got her approval yesterday.
PD-2003/EB2
RD -June 2007
Approval Self - 5/5/2008
Spouse approval -5/29/2008
 
Batch processing seems possible. Except that we are in different categories. Mine is EB2/NIW. Our last info was that the derivative application has not been assigned a case #, so we have to wait for the dates to be current. Is that true for your kids too? I'd think that younger kids dont have to go through rigorous security checks. Probably thats why no fingerprints asked. So not having a case # could possibly delay their processing.

My wife's case was approved today.

I got e-mail "Card Production Ordered".

On May 7th RFE e-mail , Request to do X-Ray
On May 22nd Response to RFE was sent.
On May 28th e-mail "Case Resumed"
On June 3rd e-mail "Card Production Ordered".

My daughter and I were approved on April 15th

TB-skin reaction was 6mm, civil surgeon did not request her to do X-Ray.

As for USCIS I think they put her case away, approved mine and my daughter's cases and sometime time in month issued RFE for hers .

BTW: How is your long RFE stuff ?

Today I called USCIS to inquire about the status on kids cases.

Time: 10.35 am
Date: 06-04-2008
Caller: My self (primary)
Responded by: Officer(she) at Texas Service Centre

Officer asked receipt numbers of my daughters and I juts gave the same.

Officer has forwarded the applications for review. Officer asked me to wait for 60 days and give them a call if I do not hear any thing from them.

I asked Officer to confirm on the priority dates of my daughters application and officer said that she does not have any such information. I have tried to confirm on this because I had one I-140 of EB2 approved in my name before Sep-2007. I am not sure my attorney made the necessary changes to transfer my all dependent applications from EB3 to EB2.

Officer is not able to give me tracking or reference number because she is not from National Customer Service Centre.

Any comments please!
 
Could you try asking the officer the category instead? Or the application RD?
In my case, even though the 2 applications in EB2 and EB1 category were posted on the same day, the RD on the receipt was 1 day apart. So I could tell by RD.
Also my lawyer says that the derivative application is tagged to the category in which your I 485 got approved. So even if both applications were approved at the same time (like in my case), if your 485 was approved in EB3, then the derivative will be tagged there and cannot be transferred to the other category.
Just what I've been told.

2 continuous LUD changes.

I asked the officer to let me know the priority date and category and she said that she does not have that information. If she is an officer at texas Service Centre, then she should have access to that kind of information. I am surprised to get that kind of response from her.
Not only that my attorney too could not speak to me confidently on the category of derivatives.

One of my derivatives had a LUD changes yesterday as well as today. Please look at my signature. I am not sure whether USCIS is working on my derivative case or just trying to send a status letter.

If your Green card is approved back in 2007 with EB3 category. Your derivatives (kids) must be in EB3 category only. Even if your attorney tried to convert your kids from EB 3 to EB 2 after approval of your Green card, it is not going to transfer. Better check your GC approved in which category.
I could see one possible problem; one of your kid is no 13+ Y. If he/she turns 14Y before approval of GC, he/she will need name check/background check and finger print etc and that will delay further. It happened with my son. We all approved in July 2007. My son just crossed 14Y and they didn't approved him as by law, name check/Background check, finger print needed over 14Y. Now struck in retrogression!

Current LUD may be due to SR, address change etc.

My and my wife approval's are of COA: E37/E39

I have just checked my and my wife approval notices. In Notice Type section, I see EOA-E37 and EOA-E39.
Does it mean that my approvals are based on Eb-3 category and not in Eb-2!
Can you please let me know!
If my kids applications are lying in Eb-3 means, my attorney did not try to convert from Eb-3 to Eb-2. I remember like he is charging me nearly $2,000/- just for converting the category.
