Here are my details.

EB-2 Concurrent.

EAD Approved on 10-07-03
AP Approved on 09-30-03
Waiting for I-140.

Guys,
I would appreciate any input on this.
My H-1 expires April 2004, my LCA just got approved from Chicago and I'll be filing I-140+485 together soon.
---- It is LC and NOT LCA (LCA is filed with H1B), if you file I-140 I-485, EAD AP immediately and get I-485 filing receipt before April 2004 you will be in AOS pending status (FYI after you file I-485 you will get I-485 filing receipt in 12-15 days)
Does this mean that I can continue to stay here legally beyond April 2004?

Is it true that if I get my EAD before that I can continue to work?
----- Generally EAD is granted in 60-90 days after you file I-140, I-485 EAD, AP, you need EAD card to work with EAD
And if not, I could stay here but not legally work?
------ You can stay in US after filing I-485 but for work you need EAD or H1.
**** As you are filing I-140,I-485 EAD,AP it means your I-140 will be still pending and if I-140 is denied then EAD, AP, I-485 all will be denied read the below link:

If I am in your situation, once I get I-485 filing receipt I will file for 7th year H1 extension and will maintain H1 status till the date I-140 is not approved( if you have not hit 6 years still you can ask your employer to extend H1) the reason behind this is that at this time more RFE are being sent before I-140 approval for education and employer ability to pay and many Indian have 3 years BS degree and on LC lawyers write 4 year BS degree needed. Play safe be on H1 status till the date your I-140 gets approved.

**Don’t forget to send color copy of your DL and passport first page with EAD application. NSC needs color copy of DL and passport page that has your name, DOB and photograph

How do we explain this...?

As I understand from the USCIS website, priority dates for most employment based categories of I-140 are begining of March 2003. Then how do we explain some of the approvals as we see in this spreadsheet/tracker. Some examples are:

How many days AP approval takes? I have impression, it is usually approved at the same time as that of EAD, at the most + 10days.

My EAD was approved on 10th november and i am still waiting for AP approval. Should i worry about this?. Any similar cases?
 
USCIS Website date means :
That if someone's case has a RD of before this posted date, it should have been looked by now. It could be pending for other reasons like RFE etc. but they should have looked at it.

If your case has a RD after the posted date, your case might or might not have been looked. So USCIS expects that you contact them only if your case has a RD prior to the date they have posted on their website.

Short answer: Their are several cases after March 2003 which they have not looked even once

Cases get assigned to several analyst. Some works faster than others. Their is not a single queue. They can be assigning by State, Group of Companies etc.. etc..

Also some cases can gets processed faster for other priority reasons....

I have seen difference upto 1 month - 1.5 month between EAD & AP approval & this is normal.

Dont Worry. If they have approved EAD, AP will also get approved.

Any one received AP recently? Mine was approved /mailed out on Nov 28, but my lawyer has not got yet. My EAD was sent out at the same day, and was received on Dec. 2.

Any one has the same experience?

Good to hear there is an I-140 approval after a long time.

Have any of you concurrent/semi concurrent filers received FP notice recently? My RD is in August. How long does it normally take. I understand I 140 approval is not required for FP purpose.

Needed Info about EAD

Company HQ: Missouri

But i told my company to file labor from wisconsin which is fast and the labor also got approved.

And my I-140, 485 & EAD all are filed at Nebraska. (You can see my earlier postings)


After I-140 Approval & with EAD approval

1) Can i work for a different company?

---- why should others search your earlier posts or waste time? Cant you post when did you file I-140, I-485?

---- If I-140 approved and I-485 pending more than 180 days and find permanent future job in same/similar skills you may work with other company if you meet the criteria of AC21 according to August 4 AC21 180 days MEMO, read the memo. Better try to get the copy of approved LC and copy of I-140 or copy of I-140 filing receipt and I-485 filing receipt before you leave the present employer
