It was EB2,
Any way I had a back up and managed to surrive, I found a good company who offered me approved labor by seeing my worst situation, I filed (I-140 /EAD/AP/485) on Apr 28th 2005, I got my I-140 /EAD/AP approved within a month, finger prints also completed recently. wiating for my 485 now.

I believe your case was appealed on 08/09/04 and
transfered to AAO 8/19/04 >EB3.Is it true?

Anyone who has filed MOTR for I-485 have any updates? My case is EB2 and I-485 reopened in Augut'05. Is it safe to assume I that I may get approval when the start the new quota in october ..any one in similar situation or have an update ..please reply..

I140 Appeal

Hi,

My I140 was denied after 2 years with Vermont Center on the basis of Company Ability to Pay. We appealed with a receipt date of 6/24/2004. In October 2004, the message changed for both the appeal as well as the I140 stating that the appeal has been sent to the AAO in Washington DC.

Then Feb 15,2005 the case was transferred back to Vermont Center. There after on August 23, 2005 they have issued a another RFE requesting for additionla information - God knows what that is !!!

I left hope of that long time back. Processing through another company and different center.

[140 --> Attorney Certified CP] vs [140/485 concurrent] vs [140/485 separate] for EB2 from NSC (Nebraska)

Gurus, please comment on the following assumptions / hypothesis. Your comments will help those of us obtaining labor certifications and getting ready to file 140. Thanks in advance.

After labor certification, EB2 cases under Nebraska Service Center:

1. 140 --> Attorney Certified CP:
Best Case : 1 month for 140 and 2 months for AC CP, Total 3 months.
Average Case : 3 months for 140 and 3 months for AC CP, Total 6 months.
Worst Case : 1 year for 140 and 3 months for AC CP, 15 months.

Risks: Before filing of CP retrogression could occur. Visas could become unavaible.
Advantages: Faster GC. Delays are more deterministic. Even if retrogression occurs for EB 2, new approvals from Dallas BEC are from late 2002 or early 2003. Unlikely retrogression will go back untill then.

2. 140/485 Concurrent or 140/485 Separate:
Best Case : 6 months for GC
Average Case : 18 months for GC
Worst Case : 36 months for GC.

Risks: Could take 3 years
Advantages: If filed concurrent, could avoid the bad effects of retrogression. If NSC really iplements 180 day approval, it will be great. Looks like for new filings this seems to be a possibility.

What is the success rate on average for such MTR's?
Mine was substitution labor and i am in the 7th year extension.We have to do motion to reopen and appeal my case to AAO.

It depends on company financial status.

Appeal going to be an option. Contact UN..He is the expert in finantial matters

I saw LUD changes on my 140 and 485 on 09/16 and 09/19. We did not received any information. I am thinking my 140 is denied so as my 485. I am on my EAD and on 8th year.My 7th year extension was expired on 05/05(I didn't apply for extension. Thats BLUNDER) What are my options? Can I able to apply for H1 based on pending labor(previous company) or Can I able to apply H1 based on I140. Any help is appreciated. Thanks

Hi Friends,

Labor certification was approved having EB2 category.

I-140, I-485 RD 02/2005
I-140,I-485 ND 02/2005
FP Done on 03/2005
I-140 RFE 04/2005 (Ability to pay)
I-140 deined 05/2005 due to a2p
I-140 MTR/Appeal 06/2005
I-140 LUD 08/2005,
I-140 RFE 08/2005 (“ need new G28 form signed by attorney or …”.)
RFE sent 08/2005, no change in LUD for more than a month after that intiated status inquiry then LUD changed and after that one more LUD but its on saturday date 09/17/2005.
Do USCIS works on saturday?
I want to know what will happen to my case.
what can be happen in my case?
1) If approved: No problem
2) If not approved: what they are going to ask again.. what can be the worst situation.
H-1B 7thyear will expire in Nov 2005.

Any advise will help
