I applied for my AC21 in June 10,2005 the denial date notice is May 31 ,2005

I need your help urgently. I just learned today that my I-140 was denied by NSC on June 28, 2005, but it is very stranged my attorney received the letter today. Anyway, I've decided to appeal my case even though I have to meet this critical deadline (Jul 27 is 30 days, Jul 30 is 33 days for mail).
My husband was H-4 status. He is working with EAD card. Can he still keep working during the appeal period with EAD card? Is EAD still good untill the final result come out from Service Center or AAO. Was he out of his H-4 status from June 28, 2005, or he still has a H-4 status? Does he need to leave the country to reapply the visa?
We plan to file a new application after we send out the appeal for our current case. Can we apply for a new EAD card based on our new case or he can transfer our current i485 to our new case?
I only received my I-140 and I-485 denial letters, but he didn't. Will his denial letter come soon?

I got my approval after deneil due to educ... eval... 3+1 year
they accepted when I did fresh eval from Trustfort NY MTR/Appeal.
Ur case get it propper latest eval and lawyer clear explantion
then U will get be approval.....

I had applied for MTR/APPEAL on may2,2005 based on wrong evaluation done.case was reopened only{ i140 } on june20.on july6 a letter was sent to attorney that case was reopened or reconsidered.
then on 7/27 and 7/28 LUD changed for i140 with no change in message.no change on MTR or appeal.spouse EAD was renewed on july20 too.Please has any one seen this pattern on MTR.please let me know.very worried.

IMO, once your 485 is reopened, your EAD is valid once again. You can go to work, provided your EAD is not expired otherwise.desp_gc said:My case details-

Not too significant, some office may have picked up this file or may have put it on another heap. Your 485 has been reopened, that is a good thing. I know the feeling when we try to analyze each LUD, but do not read too much into it.desp_gc said:Eric or other gurus please respond,

No, that is a general message, as BCIS has said, depends upon PD and visa availability.Does it really take 800 to 900 days to get a decision on this type of case?

I290B NOTICE OF APPEAL TO THE COMMISSIONER was received here for processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.
Few people not received a decision or advice from the USCIS within the projected processing time frame of 180 day’s, and then cases are initiated by Local Senate.
Please contact your local SENATE with Appeal details if you need decission fast.
