TN to H1B, Should I go to POE to get new I-94?

I got H1B approval notice for 2010, and start from Oct. 01, 2009.
Should I go to POE to get new I-94?

Your answers are very appreciated.
 
... as TRC said, it will depend on if there is an I-94 on the approval notice. Do not pay any attention to the advice on the I-797 (or from lawyer) about getting consular stamping etc, it does not apply to Cdns. If you have I-94 attached, you will automatically convert to h1 on 10/01/09 regardless of whether you travel in the meantime.

If you got no I-94, you will need -- at some point after 10/01 -- to go to border and activate it.

But in either case, of course, your H1 would only take effect in October, so any trip would be after that date. Also, you need to maintain some status (presumably TN) until that date, as do any dependents.

No I-94 attached with my 'I-797C, Notice of Action'. So I need go to POE
to active my H1B status after Oct. 01. 2009.

What kind documents do I need to bring to POE? (only 'I-797C, Notice of Action' and Passport)

I am also in the same situation and wondering what type of documents should be taken for I 94.
Also do i need to go for Pre-flight inspection for I94 or not.
Any kind of info. is greatly appreciated.
 
The Notice of action is sufficient. If it is several months after October 1, I would carry along a letter from the firm indicating that they are still going to employ you on H1. Thiswould be for example if your TN wil not expire for several months after Oct 01, and you simply don't have time/inclination to leave US.

As to the question about pre-flight inspection, if you are flying from canada, everyone goes thru pre-flight inspection, so not sure of your question. If you are asking if officer will issue you your I-94 right at the booth (without having to go to back office), yes, they will.
 
I think you are refering to "Secondary Inspection". Preflight inspection -- which, again, everyone goes through -- is normally conducted at the booth, without need for secondary inspection.

I would not see the need, unless you are originally from a watch-list country, for CBP to conduct secondary inspection to issue your I-94.
