TN to GC EB2?

Hello all,

Can 4.7 years experience pass for EB2 processing for the GC? Are they strict on 5?

The experience I have some of it was gained during and before obtaining my degree as Systems Analyst consultant. With my current employer my total experience is 5.5 years. I only have a BSc degree.

The requirements are straightforward; either you have over 5 years' progressive experience, or you do not. 4.7 != 5.

Between these two facts, I would be exceptionally skeptical that you qualify for EB2.

Just trying to avoid the EB3 3 years hole :S How long would it take to get the EAD if processing GC as EB3?

You have to wait until your PD becomes current for EB3 and then you can apply for I485 and EAD as well. How long will that take? My guess is yours and everyone else here.

And the BS+5 requirement as equivalent for MS is merely a MINIMUM guidleine. Most PERM experts say BS + 7 is more realistic.

Anything is possible. Round up your 4.7 to 5 yrs and you're ready to go. USCIS is not math professors, you know. They are not accounting dept either.

In fact: before my I-140 (EB2) was approved, everyone here is "skeptical" because I only have Bs with less than 5 yrs exp and a Master degree with 0 exp. The people here say that it cannot be approved as EB2 unless TSC make an error as big as mount everest. Isn't that interesting? Guess what? TSC approve my I-140 as EB2 and now I'm waiting for I-485.

They want letters validating the experience, and they're not all that stupid especially if they think you are trying to switch categories to avoid the priority date wait.

My understanding was that MS+0 was EB2. You only need to start combining MS with experience if you're also allowing BS+5 as well, but the nuances of EB2 with a postgraduate degree have never been my strong point.

I don't understnd the skepticism, your MS+0 qualified you. That said, your BS and experience had nothing to do with your getting EB2, it was your MS itself. The 4 years of experience didn't hurt either.

So do not be telling others that you got your EB2 with BS and less than 5 years. You got your EB2 because of MS (which is by definition).

I did get my EB2, based on what? Who knows? I don't know and I doubt that you do.

All I know is my own case. On Jan.07, TSC sent me an RFE (before approving my I-140 in Mar.07) to suggest that I should apply under EB3, even they can see that I have a Master degree. Feb.07, my lawyer reply with a letter stating that we are willing to apply for EB3 but we also apply EB2 and if EB2 get rejected, we plan to appeal it. Then, Mar.07 they send us an approval notice for EB2.

I have another friend using the same lawyer who get EB2 based on her Bs degree. She is a Restaurant front manager.

Its not always cut and dry with this system. Thats all I'm trying to say.

So, you DID have problems. This disclosure would have been better than your off-the-cuff advice to 'go for it'.

Many companies do not have the resources or patience to take a flier on a doomed PERM and then re-file.

Thanks for the advice everyone. I think I will hold until I change employers in the future and try for the EB2 with 5+ to be on safe side.

I'd quite differ on that one. One guy just recently got his N-400 sent back because he filed it exactly 90 days before his PR (you can file 90 days before your 3rd anniversery if by marriage or 5 years by employment GC). Problem is he filed on the exact day meaning INS got it and found it was 91 days before his PR. They returned it to him a few weeks later, he then had to resend it costing him several weeks on his road to citizenship. If he had filed it the next day, he would have been fine.

They can be very picky about years and exact dates. They seem to know more about math then most people do and seem to be very accurate with regarding 'month math' meaning 90 days does NOT equal exactly 3 months...
