I am Indian born Canadian Citizen working in USA for 6 years, my kids want to stay here and finish college (upto Masters- approx. 4 more years) and my second child will soon enter college in two years. My thought was looking to pay too much tuition for the two kids better to apply for EB5. My son will turn 21 in 27 months. Myself and wife both on are on individual TN status.

A) has anyone done EB5 on TN status and what are the challenges as TN is a SINGLE Intent status.
B) if i apply and my priority date is LOCKED in of Aug 2026, will my son still get conditional GC even after he turns 21 and will still get permanent GC after removal of conditions.
C) Risk of EB5 on TN- not able to get EAD on time and NOT able to renew TN. Has/was anyone able to renew his TN even after filing EAD(i797) and Adjust of Status (i485)
D) If i get EAD (now 18months only) based on EB5 if I use it - and not able to get conditional GC within 18 montsh (EAD expiration) can the EAD extension be filed and what if extension does not come on time also the conditional GC- what will be my family status in USA.
E) it is better that we file as one spouse and two kids as Adjust Status based on EB5 and one spouse remains on TN , then later add on the spouse once I526 form is approved? will this be better.

Just thinking various scenario

Please read the Curiousgeorge TN->GC link thread. It answers all questions about your TN/GC.
For questions about your son's GC, ask on an AOS forum, but there is no such thing as a conditional GC when employment-based. It is only for marriage-based GC when the marriage is less than two years.

Thanks Nelsona the EB5 has 2 year conditional look at form

Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status

I have read the EB5 program and all investors has said that you get two year Conditional GC ONLY. that also the GC and AOS forums does NOT consider TN status holder doing AOS and what risks are involved which i tried to ask questions on.
