TN renewal questions.

Hello,

My TN-1 expires April 23, 2007 and I am likely to fly to Canada to renew it at the border.

What would be the earliest possible time to renew it? If I show up before the immigration officer 1 month before visa expires, will there be any issues? The renewal date will be April 24, 2007 or the current date at the POE?

In the company's employment extension letter, can they indicate the period of extension starting in the future, for example, May 1st, 2007-May1, 2008? Any special rules regarding the employment period dates during visa extensions?

I ask these questions, since the company I work for has no idea about it and it's up to me figure it out.

1. yes you can renew it one month in advance. the new expiry date will be 364 days from the date you are at the POE when you renew it.
2. have the company write "an extension of one year" instead of specific dates.

if you did a mail in renewal, the new expiry date would be 364 days from your old expiry date. USCIS is processing renewals in less than 2 months now. that would be a much easier option for you.

I may explore the option of mail-in TN extension option as well. No tickets to book, no time-off needed from work. However, the HR person in the company may have a hard time understanding some of the questions in the I-129 application, I may have to fill it out myself and let her sign it.

Is it true that the renewal process is under two months? If so, it's a really good news for me. Mine filed on Feb 15th, and I wish I can get it ASAP since I have to go back to Canada by the end of April due to some commitment. How many people have you heard that they received their renewals within 2 months?

That was how almost all of my immigration paperwork was done. I was happy to answer any questions, but ultimately it came down to "shut up and sign it".

give us more details. such as what visa you are on now, what visa you want to apply for, etc. tell us more about your situation.
 
I don't think the person is on a visa at all, I think he's actually on TN Status and is just wanting to know if he can start working at his new job right away when he sends in the forms.

The answer is no, you MUST wait till your get approval and a new TN for that new job.

Problem is applying for another TN by mail can take some time and until you get it, you cannot work at that job (some employers may not want to wait for that if you don't get preimium processing)..

The best thing to do to get a new TN for a new job, is to go to the border and apply there. That way you can get it right away and then immediatly start work. Either that or fork over the $1000 or so for Premium Processing (not sure how long that takes, I never did it while on TN Status, but think it's under a week).

Mail is usually only good when you are applying for a new TN Status with the same job as you had on your previous TN (the one you're currently working on). This is because if you apply for a new one, the old one gets extended up to I think 240 days while the new one is getting processed. This is not the case when applying for a new TN status for a NEW job...

It doesn't matter to me if I pay or the new employer just want to make sure if I pay it's not breaking some Immigration law/rule/requirement.

I don't think it matters actually. Not certain, but I really can't see it mattering who pays at all...
 
There is no rule as to who must pay TN costs. The only fee that I know of that MUST be paid by the sponsor, is for H1: the data collection fee. And the cost to send an H1 back home at end of job.

All other costs and fees are up to negociation between the sponsor and the beneficiary

Mailed paperwork on Jan 14th, received aproval notice on Feb 8.

Wow! lucky you. It took me seven months to get my TN renewed last year (Apr 12, 2006 - Nov 20, 2006). I bet after Apr 1, 2007, it will slow down again because the processing of Tn is affected by the numbers of H-1b applications. You kicked in right in the gap that they have finished last year's H-1b but not started this year's yet...

So here is my suggestion for those who want to renew their TNs. Either renew your TN by mail before end of March, or go the POE after April 1 to avoid another lengthy frustration. Prove me wrong if anyone could provide evidence that the USCIS actually aliquot resources to process TN and H-1b, and the two processes could go at different paces. Historically, it seems to me that the processing dates for these two kind applications are always boundled together.

The only for predictable thing in terms of dealing with USCIS is that their pace is unpredictable.:D
