hi all plz help us......tn experts
1. we ron tn td visa since 2006, n this yearmy comapny applied h1b for me in april n i got receipt no in may08.
2. my tn was expiring in july so i renewed online my tn but my employer somehow forgot to send the documents to usics.today morning i received a mail from usics that my h1b has been held up , on contacting my lawyer he says he n as well as my employer received a letter of tn REJECTIOn... iam shatterd nw.
4. my wife who is indian citizen also is out of ststus n USics letter shows we have to leave the place nw.....
5.. what can b done now plz help.. help .. help/....
 
Go (alone) to border and get TN. I would not wait to find out what was wring with your I-129, just make sure you have good petition for the border. Wife then needs to arrange to go to a Consulate and get TD. Obviously you have not been out of status very long, so you should have no problem.

Your firm should be firing their lawyer.

The fact that your H1 is delayed is of little importance, you still needed a TN. Your H1 will be approved in the course of time -- as long as your firm keeps answering nay requests.

Focus on what needs to be done instead of getting worked up...
and please type a little more clearly.

Well, you did have the presence of mind to (a) find this site and (b) register. So going the extra step to write a clear and concise problem statement was not beyond your capabilities regardless of your percieved state of mind. Particularly since there is an edit feature on this board.

Writing legibly is being courteous to those who might help you. As would refraining from ALL CAPS screaming.

Been there done that....I've been in your shoes, and it looks like your freaking out......so STOP.

We have helped many people on this forum and you're the first who can't seem to think straight.....so calm down.

I helped someone last month who was in the identical position to you....the only difference was he actually got asked to leave the office.

You can PM me if you want and I'll tell you the steps he took based on where he lived. He almost took a six hour drive to the wrong border. Not all borders do TN's.

Also, his wife, who was also from India insisted on going for the drive. I got on the phone with her and explained at the time that that was the worst thing she could do as he might get his TN, but she might get stuck in Mexico.

Long story short, after calling around a finding the correct border, he went there got his TN no problem (as a matter of fact, the CIS guys weren't sure how to do it), and now he's able to do everything by mail for his wife.

WE WILL HELP YOU. STOP FREAKING OUT.

The implications of petition rejection are serious, and folks tend to react strongly. At the same time, staying level-headed is critical to ensuring a good outcome.

just got my new tn from the border....
now my question is is thr anyway for my wife to get td visa not going through the consulate interview... boz iam trying to book an apt online and from toronto to vancouver No apointments.....

AVR will work, since she was presumably in TD status to begin with. She just needs to go to border to get I-94, which is expired now.

I wouldn't bother with consulate at this point, since you are about to get H1. THEN, she really will need to get an H4 Visa at some point when leaving the US.

what is this AVR.How does it work for this case as she doesnt have valid I94 and TD visa.I think she should go to the consulate and get new TD visa.
