There is a fee for first time EAD (pending asylum)

I found out today from my lawyer that uscis charges a fee for the first EAD based on pending asylum. USCIS will charge me $340 because I had my old EAD that I got through OPT status. That EAD already expired and now I am filing for my first asylum EAD. My asylum case is still pending.

I thought that the first pending asylum EAD is free even if you had EAD in the past that was not through asylum application.

Is that information correct or do you think my lawyer is wrong?
 
There is no fee for mthe first time applicants but make sure to write the right catagory on the application.

I am the first time ead c8 applicant but not the first time filing for ead.
Will it be considered renewal or totally a new ead?
 
My ead ( under c8 ) was approved two months ago without fees. I received three EADs in the past under f-1. So they should waive the fees.
 
in the form: I'm applying for... select: *Permission to accept employment
question 11: (yes)
question 16 put (c) (8)
and fill the rest of the form and send it to the "correct" USCIS office with tracking number "priority mail is a good choice"

remember to include copy of asylum case receipt.

Do they need a copy of my previous EAD?
