Tax lien and settling penny on the dollar (or uncollectible) with the IR and citizenship application

Hello,

I am trying to apply for a citizenship now but I have a big problem with the IRS.
I filed three years of taxes late and now the state put a lien on one of my bank accounts.
I am indebted for $100K with credit cards as well. I have no assets or cash to speak of, aside from two cars.

I am self-employed and the past three years were the most horrible years in my entire life here.
I am trying to file a BK in one year and start all again.

I have two questions:

1. Would I have trouble getting a citizenship because of this big tax problem with the IRS?

2. I might end up settling with the IRS, pennies on the dollar OR as uncollectible. Will this pose a threat in getting a citizenship timely?

As long as you can show that you have a settlement plan with the IRS you'll be fine.
Simply ignoring the IRS and not paying them is what gets naturalization applicants in trouble.
 
So what you are saying is that as long as I have settled with the IRS even though the IRS determined my tax is not collectible and isn't trying to pursue a dime on my tax, it will be fine in terms of getting a citizenship: I do not have to have a payment plan with the IRS in which I am to pay a certain amount of money to the IRS.

Am I understanding you correctly?
 
Bottom line is, you cannot owe taxes to the IRS without their (IRS) agreeing on the eventual outcome. Whether it be a payment plan or IRS making a determination that taxes are not collectible. You need to have IRS on the same page as far as USCIS is concerned.

As long as you have a settlement plan, whether it be that they determined your tax is not collectible or you have a formal payment plan, you'll be fine.
 
I will call the IRS and try to negotiate the terms first.

An IRS payment plan does not slow down naturalization process. What USCIS wants to know is if you have any outstanding taxes to the IRS that you haven't taken care of,and if so, whether you have evidence of a payment plan or an agreed settlement plan.
