Stuck in Name Check??? Let's track it

When FBI returns a positive result (FBI found some information about you), USCIS will forward your case to their Fraud Detection and National Security Unit. Only after review by that unit can your application go back to adjudication. Your response seems to indicate that the case is currently with FDNS Unit.

Given that I'm almost guaranteed to have positive FBI response as well, it will be very interesting to see how long will it take FDNS to review your case. Please, keep this forum posted on any developments regarding your application.

I created service inquiry and I received a letter saying they are doing national security stuff.....

Earlier I took infopass and i was told that fbi name check is done already!

4 FPs so far (last one May 07)
STUCK IN NAME CHECK: from Jan.29, 04
Last LUD Jun.,05

Contacted USCIS n-times, senators, congressman, obdusman, First Lady. Still waiting...
 
I am also in the same boat. There is no way to contact FBI, while USCIS just pushes it to FBI. No help for any one..... helpless... so depressing.

I don't know, if Senators office contacts the FBI or USCIS for status on name check?
 
I'm losing faith in FL too. Contacted her on March 8th. FBI responded with the "in process" letter. According to USCIS, as of today, it's still pending. I think I'll wait another year and go back to Moscow. Fck this.

people have waited even 10 yrs in US so that one day life is better.

Yeah, but this waste of time seems more like a sacrifice that I can't even justify anymore. I've been stuck at my job for the past 9 years. Managed to get a masters degree through part time, that I don't even need at this job, could not go for a PhD, of course. I'm sitting on my ass watching my colleagues come and go to make twice my salary. Meanwhile wages in Moscow are about to supersede those in NY. And it's not just about the money. It's like I'm waking up from a dream, thinking what the hell am I doing here. Mybe this is too personal and too rhetorical for this forum. Pardon my exclamatory tone.

my wife is in Moscow, and she can not even visit me here
Actually I found a solution how to bring her here, and I hope it'll work.

But if it will not, then I guess I'll go for consular processing
It will sure take less then 4 years I've already waited.

Oh! this is tough! So you've been seeing your wife 3 weeks/year while the FBI is investigating you? Did you say you have a fiztech background or was it somebody else? I'm wondering if really all russians get sucked in the NC or just the best of us :D

A little bit more - 2 months/year. My boss understands.

My PhD adviser also waits for GC from 08/20/03, but recently he's got first RFE "Incomplete medicals", so may be he already unstuck :)
 
I am interested in filing a wom since stuck in NC for 3 yrs. All examples of pro se complaints are different from a regular EB 485. People have applied in person or gone for interviews which is different than regular process.
Can anyone please provide me a word document of a wom complaint that I can use for my own complaint that I plan to file this week. Thanks.
 
Previous namechecks validity for 15 months

I have recently submitted my AOS application, so I have a long way to go. I am mentally preparing myself for a long wait.

I was curious about a couple of things and was wondering if anyone had an answer.

Is this namecheck process for I-485 similar to namecheck process for non-immigrant applications like H1, J waiver. the reason I ask is if they conducted namechecks for those applications and it is within 15 months, they (according to their memo) can use a name clearance from another application if it was completed within 15 months. Anyone has any experience?
I had J waiver and then COS to H1 processed within 15 months and I assume that they would have conducted the namecheck for those (my J waiver took 9 months, some got it in 2-3 months and I assumed that it took that long bcz if NC). Would that mean that they may not do another check and process my application.

Second, if they do initiate a second check (even if there is a prior one within 15 months from another application), would that predict a fast namecheck process this time as well (relatively fast!!!!)?

The USCIS only sends name check requests to the FBI under the National Name Check program for AOS and Citizenship applications. I wasn't aware of non-immigrant visas being encompassed under the name check program. Not to say that these visas might be subject to a relatively minor security certification prior to visa issuance, but I doubt strongly that these compare in size and scale of the Name Check itself. The latter is only for AOS and N-400 cases.
Now, name checks are valid indefinitely through the lifecycle of the case until the adjudication of the case. There are times when USCIS may request a secondary name check from the FBI, if the original request has taken inordinately long, which in their world is all relative. That said, fingerprints (biometrics) have a validity of 15 months and need to be redone every 15 months until the case is adjudicated.

I thought it was the same thing. By the same token, Security check at consulates abroad for NIV are not the same then. I have heard stories of people getting stuck abroad while getting a new or renewal visa.

NP. Yes, they definitely do not follow the same procedure. You'd think they'd standardize it, but applying for visas outside the US and within it are quite different from what I know, including security checks. Consular Processing related name checks are known to be much faster then AOS ones...don't know why, but it is what it is. Not sure if its 100% true though.
One would think you'd want to process security checks for individuals already IN the country than those outside of it trying to get in, but what do I know? I'm just another tax paying, law abiding immigrant.

Please note that Name Checks are more then one type and depending on the case may be valid for 15 months only!!

Associate Director of Domestic Operations, Michael L. Aytes, has released a Memo dated December 21, 2006 which explains the current FBI Name Check Policy and announces changes in USCIS policy with regards to missing or incorrect date of birth, validity periods, duplicate requests, and expedited name checks.

I am russian (EB2) - stuck from Feb 06 (according to this forum it is nothing), two russian friends who are married to US citizens are stuck from 2003/2004.

Call me stupid but I think that there is something to do with a nationality
