Stuck in Name Check??? Let's track it

2nd finger print
We just got notice for 2nd finger print early this week. Our casde was filed in Dec. 2003 at VSC. It's pending name check. Tried both congressman, senators and first lady. None seemd to work. Our PD become currnet this Feb and 1st FP expired this March. So after receiving notice for 2nd FP, I called VSC and was told that they will only send out renew FP if they see the case can be adjudicated, meaning security check cleared. One warm-hearted office I talked to told me mor edetails. It turned out my spouse's ( primary applicant)name check is cleared and that's why they send out 2nd FP. As of me, they need to keep both files together and that's why i got to do 2nd as well. ( mine is still pending. we were told NC was initiated in Jan. 2004 ).
I think if your Fp has expired and you receive a renew, this definetely means your security chekc is cleared at least inVSC.

And here is advice for those resorting to congressional help. I just called Clinton's office (NY) to follow up on my call for help. They have a 2-year backlog, so you need to politely insist that they look at your file now. So even if you contacted a senator's office already and you think they are doing something for you, try to make sure that there actually is a case worker involved already, otherwise it's all vague. Hillary Clinton's Immigration department is at 212-688-6262, for those of you in NY. I spoke with a very warm-hearted girl Julia; she is really quick too. They have some liasons in FBI and USCIS that they talk to directly and get answers qiuck. I doubt they have influence but at least they get the info that we don't. For example, she told me that all the bullshit that I got from USCIS over the mail lately was due to some contractor who was working for USCIS on my case. I wish I could put that contractor back on wellfare.
And on this note.....good luck.

Online status shows that my case has been approven yesterday - NC pending for more than 2 years. Applied with my husband and he got GC last year. the lawyer filed AILA in June 2006. No lawsuit

Name check and finger print check cleared what next?
I called the FBI today to find out about my finger print check and i was told on two different times that my finger print check was cleared the same they i did the biometrics which was on the 22nd of sept. 2006 and was forwarded to the USCIS. Can anybody tell me if this can be done so fast and if so why is there USCIS not doing anything about my case because i thought the I-140 and I-485 approvals were based on the name check(which is also cleared) and the finger print check.

I am new to this forum. I just found out at an InfoPass interview this morning (Boston) that my name check was pending although my wife's has already been completed. I jumped over from the VSC/I140/I485 thread so I am new here.

Your namecheck can be expedited by USCIS. Previously people used to write representatives from congress, senators, mr. president and the first lady and it used to help, at least to some extent. However once these avenues became commodity FBI stopped paying attention to those "special" requests, they stopped responding to name check status inquiries via email as well.
Search the forum for name check expediting criteria memo published by USCIS. The criteria include extreme medical conditions, lawsuit (WOM) pending in federal court and something else. You can still contact different elected authorities and solicit some help, at least this would be the way for you to exaust all available administrative options.

Looks like your name check got initiated just more than one year ago. Not to discourage you, lots of people on this thread have been waiting more than two years( mine is already 2 year 10 months, and still counting...the primary in my case just got cleared name check this month)

I am thinking about a lawsuit also. My name check has been pending for more than 3 years. By now you would think the government knows more about you than yourself, yet they still put you in an infinite wait. I am sick to my stomach whenever thinking about this.

I am wondering if waiting more than 3 years alone gives you a sufficient ground to sue them. I am getting close to the 3 year mark myself and thinking of suing too, but I'm not sure my motives would be convincing to them. I don't have a family here, I don't have to travel, no sick relatives abroad... Yes, my freedom is very limited, but that's still an efemeral notion.desi_boy_usa said:

My 485 RD is July 2003. Still stuck in the dreaded name check. Followed up with the USCIS, Senator and Congressman. Finally got a senators reply saying "Pending Security Clearance". I hope the senator inquires now with FBI.
I will give till end of the year for the name check to clear, if not, I file WOM. Let's see. I think I have a very strong case + a letter from USCIS dated early july 2006 that my background check is pending.
Contemplating whether to hire a lawyer or go pro se. Any advice ?
