I am sorry if this question has been posted here before.
I am trying to find out how you learn about the FP and name clearance. Is this indicated when you check the status online or is there any other way of telling the FP and name cleared?

Attorney Misspelled Name
In filing for my 485, the attorney made a mistake in my middle name. The correct spelling is VARDHAN, while the attorney filed as VARDAN.
I realized the mistake when I got my AP. Now the attorney has sent the revised 485 form. I am not sure what is the implication. If any body has any information how does USCIS handle such cases please advice.

I initiated inquiry thru local Congressman and called USCIS Customer Center couple times, every time got the same respone... 'Awaiting security clearance'. Don't know how to get this expediated...
Is class action law suite against USCIS is the only option? I heard it helped many others in the past... Any suggestion/help is much appreciated?

I think your right in your prediction. I worked in many different states as a Consultant and now awaiting 'name check' since 03/2004.... I tried my level best to approach all the dignatories including local Congressman... NO HELP. Dont know wat to do next....?? Any idea or suffestion???

Good news!
My Green card application was finally approved. This is my timeline, in case it helps anyone. There are some updates since my last post in june..
---I-485 Filed - Feb 04
---Name Check filed March 04.
---CIS interview Jan 05, where I learned about the pending name check.
---Sent FOIPA request Feb 05. Got a "no records" response within a couple of weeks.
---Sent certified letters to Hardy, Cannon. Mar 05, and again a couple months later.
---Contacted Congresswoman April 05. While her office claimed they couldn't do anything to expedite the case, they did give me a case status (pending) very quickly, and gave me an update every 6 months. They were also the ones who informed me I was apporved.
It was around this time that the visa numbers in my category were used up, and later retrogression came, so I didn't do anything for over a year, knowing there was another bottleneck even if name check clears. The last visa bulletin was very close to my PD, which prompted me to:
--- Jun 19th 06, faxed a letter to both my state senators.
--- Jun 22nd 06, heard from Congresswoman's office that check had cleared. Told senators I didn't need any more assistance.
--- Aug 17 went down to local CIS office on infopass. discovered that I had two name checks associated with my case!! (both on me). One was indeed cleared on may -2006. The other was still pending.
Frustrated, I told my congresswoman's office and lawyer.
--- Sep 6th Got a letter from CIS that GC application was approved (on Sep 1st). September is also when my PD became current..
So apparantly, my second name check was approved in late August, and my case was immediatly approved as well.
Thanks for all the support, I wish you all well with your own Name Checks and applications with USCIS.

As many of you know from calls and previous posts on this list,
American Families United is working with Morrison Public Affairs Group
to lobby on the name check issue. Former Congressman Bruce Morrison,
who served as chairman of the Immigration Subcommittee from 1989-1991,
is working with us directly.
We have approached several Senators and Congressmen and lobbied to
establish a process where delays in name checks would be reviewed and
addressed. I was pleased to find out last week that members of
Congress are right now working on the technical details of what might
become a bill or amendment. While there are no guarantees, this is
an extremely positive development.
It takes a lot of effort, time and money to accomplish our goals. We
would like to be able to reach out to larger organizations
(businesses, foundations, etc.), but we need to become a formal
(lobbying) non-profit to do so. This requires us to obtain a
501(c)(4) status. To do so, we need about $4,000 for attorney and
filing fees.
In addition, we are only paid up with out lobbying efforts for a few
more weeks. We need to raise another $5,000 to continue lobbying up
through November elections, a very critical time for our efforts.
At present, we have less than $2,000 in the bank, about $7,000 short
of what we need obtain non-profit status and continue lobbying.
Please help us accomplish our goal. We have 350 members on the name
check tracker group, and if everyone made a one-time donation of $20,
we would have enough money to obtain the 501(c)(4) status and continue
lobbying on the name check issue up through elections.
Twenty dollars is a small amount to contribute to a cause that
everyone would benefit from. It is less than an initial consultation
with an attorney, which normally costs about $100, and it is far less
than filing of a writ of mandamus, which can cost between $1,000 and
$5,000. If successful, though, this effort would be no less effective.
Please help us help you to get the name check behind and start living
a normal life again. If you wish to donate, you can do so at

Aclu Seeks Assistance In Suit Against Ins District Offices
ACLU SEEKS ASSISTANCE IN SUIT AGAINST INS DISTRICT OFFICES
The American Civil Liberties Union Immigrants' Rights Project is seeking
information to prepare an amicus brief for the US Seventh Circuit Court of
Appeals in a case involving exclusion proceedings against a lawful permanent
resident.
Recently the Federal District Court in Chicago ruled that a lawful permanent
resident in exclusion proceedings is entitled to an individualized parole
hearing in from an immigration judge or other impartial adjudicator. The
judge in the case found that the new Section 236(e) of the Immigration and
Nationality Act which allows INS district directors to solely decide to
place someone in custody is an unconstitutional denial of due process.
The ACLU is seeking evidence for its brief to back up the contention that
district directors are "structurally biased" and that district directors do
not fully and adequately consider the merits of parole requests and
routinely deny them in a cursory fashion.
The ACLU is asking that immigration advocacy organizations and immigration
professionals provide information on the following questions to Cecilia Wang
at 415-621-2493 x 16:
1. Has it been your experience that district directors routinely and
typically treat parole requests in a cursory way, and deny them without due
consideration of their individual merits?
2. How do district director parole determinations compare to immigration
judge bond determinations, as far as the depth of the analysis and weighing
of factors?
3. Does your organization have any actual district director parole denials
that tend to demonstrate that district directors approach parole requests in
a "cookie-cutter" or "rubber-stamp" manner; i.e. that district directors do
not give each request individualized and careful consideration? Any such
sample denials should be typical.
4. Does your organization have statistics on the frequency of district
director grants of parole?
5. Would your organization be interested in signing onto the ACLU amicus
brief?

2. How do district director parole determinations compare to immigration
judge bond determinations, as far as the depth of the analysis and weighing
of factors?
3. Does your organization have any actual district director parole denials
that tend to demonstrate that district directors approach parole requests in
a "cookie-cutter" or "rubber-stamp" manner; i.e. that district directors do
not give each request individualized and careful consideration? Any such
sample denials should be typical.

Need advice for Name Check
I am new to this forum, but first I want to say this is the greatest forum I have ever been. Thanks for everyone who provides so many valuable info. Here is my situation needs some help. I am currently holding H1B and married to a USC 2.5 years ago. We didn’t file i-485 until my husband became US citizen this June.
We filed I-485/I-765/I-130/I-131 altogether on 07/09/2006. My RD for all cases is 07/13/06. I did finger print on 08/02/06. I was scheduled for interview 09/14/06, didn’t expect that soon, only in two months?
We went for interview last week in San Francisco, everything went very well, GC was approved but pending with Name Check. The immigration officer did say since she couldn’t stamp the passport, she will approve the I-765/I-131 that day. Now I have two questions want to ask the expert in this forum:
1). Since my interview was scheduled really soon, only in two months, should I give FBI some time to clear name check or I need to start sending all the emails to various party such as senator/congressman right away? I was told by officer my name check was submitted to FBI on 07/25/06.
2). I only got the notice saying my I-130 is approved today, and didn’t get approval email notice for I-765/I-131, they are still pending when I checked online status. But I definitely heard the officer told me she will approve my EAD/AP during the interview, should I worry about this?
