btw, I strongly suggest that you take an infopass appointment and confirm what is said in the letter. From reading some people's posts here, it appears that NC can be cleared/not cleared depending on which CSR you talk to.

Also, now that EB2 becomes unavailable on Aug 1 , let us hope they resolve your case by July 31st.

My Priority Date is June, 2002. All I can hope is, come October, EB2 does not retrogress to that date. I dont think anything will happen before 31st of this month.
 
Isn't it amazing how the system works.
When you are stuck in Name Check, the PD is current.
When the Name Check is cleared, the PD is retrogressed.

Its a game of musical chairs really.

Another amazing thing is that your Name check is cleared and your PD is current and still the officer doesnt reply to your enquiries for over 3 months.
maybe his brain check needs to be cleared.
 
FBI response to FOIPA

I just got a letter from FBI saying "...No records responsive to your FOIPA request were located by a search of the automated indices.....You may file an administrative appeal by writing to the Co-Director...". ;) Nevertheless, I've been in NC since 2004. :eek: So what are these "automated indices" and how did they get me in NC if there are no records? :confused: Are there different kinds of indices? :confused: What on Earth is administrative appeal? Has anyone heard of this?

No records means FBI does not have any negative record against you which is a good thing. This is my understanding. If your name is stuck try your Senator office to help and find out from local immigration office that when was it sent to FBI. Send them an email and write a letter too.

Simple. Your combination of first name + last name + date of birth yielded no records in database.
But, for the purpose of NC FBI assumes that you could have changed something (FOIPA is for you and you have no reason to lie, so they check only information you provided). So they run only the last name through the database. And some hits may have been detected. You know, if FBI spoke with somebody (for example "- do you know the guy, who lived in this apartment 7 years ago? -No") they will put his name into DB.
 
Petition, anyone?

Hi, all!

I guess I have been also stuck in name check (see signature for details). This thread would serve better if USCIS immigration officer read it. The reality is that no one else is reading the many words typed in here except us.

That means we need to let people know that we are waiting too long. (Remember the protest for and by illegal immigants some time ago?). One effective way to tackle the name check delay would be to write and send a petition to USCIS or FBI director or Senate. We need to tell them that we, legal-immigrants-wannabe, are waiting and suffering.

Maybe someone can write a petition that has a cover letter and main body. The main body would have the following information: name, address, A#, Priority date, and signatures.

Maybe we can appoint or get one volunteer who can represent each state. These representatives can then submit the collected signatures to someone (national representative), who will then deliver the petition to USCIS, FBI or Senate.

I would like to hear from you! Thanks for reading!

Means that there is some variation of your name, or your name is in some record that is NOT ABOUT YOU.

For example it is in a list of Moscow PhysTech graduates. It will not trigger a direct hit.

That's a popular conspiracy theory nowdays. :eek:


P.S. I am just 3 month into the process (and from a better physics department :cool: ) and thinking of the security clearances I have had passed, with its associated paper trails all over national labs... That LUD I have had on 7/13 - I just wish it was something good. In any case. Russian. Nuclear Scientist. (in my previous life). Name check. Does not sound like a good combination.

A followup. After getting the letter on Friday, I saw FP notices in my mail box today. I immediately went and got the FP done. ( The Application Support Center im my place is really good. I was in and out within 20 minutes. )

3 Days Wed, Thu, Friday to get there. If not God knows how long the wait will be.

I called VSC today and found my I-485 is still pending for "Name and Date of Birth Check" in FBI. I assume this is the namecheck everyone is talking about. My case detail is:
EB1 OR concurrent filing RD: 2/17/05
I-140 AD 9/26/05
Fingerprint 4/19/05 (LUD 4/27/05)

Is there anything that I can do to speed up the name check process? Many people mentioned asking help from senators. Can anyone tell me the process of contacting senators to get help? Can senators really help with name check?

Yes, I use the 800 number. Go through the whole normal process and then choose "If you have multiple cases with us....", choose that (I think it's 4). It'll bring you to VSC.

Could you please let me know how you got the operator give you this information, every time I called them, they always told me they can only file a case-status inqury and they can't access my "personal information"

If you get the representative in the national service center, they won't tell you anything. You have to get to the individual service centers to get more info about your case. See my message above.
 
Get approved within 3 months after filing the lawsuit.

I have been visiting this website a lot. We are also stuck at name check for a long time. We have already fingerprinted twice. Get EAD/Advanced Parole three times. Tried all the ways we could think of without any results.

Finally, we hired the lawyer and filed the lawsuite against *** (I don't even know who they are). Here is a portion of the summary we get from
U.S. District Court, California Northern District

COMPLAINT; Summons issued; against Christina Poulos, Alberto Gonzales, Michael Chertoff, Eduardo Aguirre, Robert Meuller ( Filing fee $ 350, receipt number XXXXXXX).
----------------

The lawyer charges $3000 for a couple, and the court fee is about $400. Usually the case will be cleared within 3 months. I think it's worth the money. Finally, this endless waiting torture ends. Hope this information is helpful to other desperate waiter.

We filed the lawsuite on 05/10/2006. My husband's 485 get approved on 07/17. Mine get approved on 07/25.

Congratulations! You definitely deserve the 485 approval!

I guess a lot of people in this forum are very happy after posting their PD and the number of days they have been waiting for the approval, hoping that Michael Chertoff or his friends would check this website. The reality is that DHS is too busy to listen to them, unless you REALLY ask for the approval.

Re-instating my approval dates. Somehow they got deleted during the last couple of months. My nc got cleared and case approved also after the Manadamus lawsuit. Congrats to gcwww!

Hi gurus,
Has anyone any idea what this message means??It appeared on the site after USCIS received the response for RFE..Thank you.

"On June 16, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done"
