Dima Can you tell us what did you do to get the process moving and how do you know that it has been approved.

the most difficult was to get through the name check. I asked 2 senators and 2 congressmen for help. Both california senators - Boxer and Feinstein were quite useless, they forwarded me fbi replays that my name check was pending and didn't do anything else. One of congressmen (representing our town) sent inquires to fbi every two weeks until the name check was cleared. Another congressman (a personal friend of the president of the company I work for) trucked the movement of my file through several fbi offices around the country. I don't know if any of these helped or the name check was completed just by its' own way. It took 2 years, 5 months, and 27 days.
As soon as NC was done (the first congressman notified me about this 5 days before fbi did), I sent email to CSC division XII asking them about my case. They answered that my I485 should be adjudicated in 4-6 weeks. After 6 weeks passed and nothing changed, I sent them email again with the same question. They again answered that my case should be adjudicated within 6 weeks. Two weeks later (since there was not a single LUD) I sent another email with the same question. The answer was: "I have pulled your case and requested immediate review." 5 days later I got a phone call from congressman office and they told me that my case was approved. Two hours later I got a email from CSC that case was approved and card ordered.
 
Pending Securitycheck/namecheck since 2 years

I was watching this forum since last couple of weeks. and decided to share my exp. with u. I am also stuck with CIA/security check/namecheck mistry. I send handfull of letters to Newark office, contacted senator/congressman, but didn't help. i also wrote email to FBI in Aug - 2005 and same time also submitted FOIPA to FBI, but no response from FBI yet as it take quite amount of time. today its almost 2 years since i applied and 17 months after my AOS interview and no luck...
I filed AOS application base on my wife is USC and we married in Sep-2003.

Hey, I am in New Jersey and working with Congressman as Sanator refuse to help in FBI case. My Congressman also don't want to contact FBI. can i contact another congressman or sanetor from diffrent state or region to help me?

I guess I have no choice but to wait and wait..Senators/Congresman are all useless in this regard in my opinion. They are scared shit of interfering in this.

Which FBI offices? Your former residences in different states?
Have you ever done FOIPA request with FBI? Have you got a copy of your FBI file?

I faxed FOIPA request in November 2004 and got "no record" response in 3 days.
Yes, it was regional offices in the states where I lived.

You said you faxed fOIPA to FBI regional office? within 3days response is very fast.. can you please tell us FAx# for that.. do you have idea about i-181 (creation of record for parmenent residence). I have I-181 initiated but namecheck still pending.. please tell me if you have any idea about such case.

I faxed FOIPA fo Washington DC, exactly how it was suggested by Rahul Kumar.

I don't know anything about I181

I added my Name in this Tracker, namecheck started on Nov-25 2003. emailed to FBI on Aug 17,2005 and filed FOIPA to FBI on Aug-31, 2005. No reply from FBI yet. :(

Interview AOS Date: 08/15/2005 - Baltimore, Maryland
AD: none, wait for name check

At interview officer told me that there are ~500 people who stuck in name chek for two years in Fallon Federal Building (Baltimore)
 
By the way, Senator's Officers telling that they are powerless for name check expediting.
There are cases that are pending name check for 4 years.

Typical situation where there is no any effectively working democracy is left and power is usurp by military complex with generals and war-mongers in charge.

All admitted that none of the name checks would stop terrorists from US attack.
 
Does anyone know how the new cutoff dates affect us?
If I understand correctly, even if NC is cleared we cannot get GC until the priority date is current. Is that right?

I am so depressed. What is the end of my problem? NC is not cleared then the priority date regression. Is it the fate that I am not meant to be a GC holder?
 
I called VSC yesterday. they told me the requested NC date is aug 8. now, it has been more than one month. they have not got reply form FBI yet. I guess I am stuck in NC too. :( :( :mad: :mad:

I guess if you don't get your NC cleared in one week, you will get stuck for years. Forget they said 120 days with 99%. It is meaningless. Am I right?

Well, summarizing everything I learned about NC procedure. I can say there are several categories of people

1) NC being cleared within 3-4 days (no match in databases)

2) NC being cleared within 90-360 days (match in computer system and all documents are available in electronic form, just requiring for an analyst to take a look)

3) NC being cleared after applicant starts to make noise and write letters to senators, FBI RMD divison etc (probably either the same as category 2, just been overlooked or requiring non-electronic paperwork, which is physically located in the FBI HQ)

4) NC cleared in 2-4 years disregarding whether applicant makes a noise or does not make a noise(cases requiring paperwork which is not electronic and is either in field offices or overseas. This category also includes cases when the REAL investigation is required, not just an analyst taking a quick look).

5) NC cleared through the "NC expedite processing", either after writ of mandamus lawsuit or something else ( I think, those are cases of category 3&4)

6) NC cases that are plain impossible to clear (required paperwork is missing). Those can allegedly be dragged up to 20 years and dropped only after they get too old.


Now, 1M dollar question will category 6 cases be cleared through the procedure of "administrative closing if there is no information regarding foreing intelligence or terrorism" after WOM lawsuit or not? . We are yet to see...

Not laways true, the tapes get loaded from FBI to USCIS in 4-6 weeks time
