Status Question

I am a physician on H1B with I485 Pending. I was on J1 visa until december 2000. I obtained a J1 waiver dated Nov 2000 and I applied for H1b in December 2000. I did get H1b approved in May 2001.The H1B stated that they had changed my status and the I 94 had the same number as it was on my last entry on J1 to United states. I have a valid H1b and also got my extension h1B and have traveled with no problems. I had a valid I 94 at the time of applying I485 .Is there any problem with this.(From Dec 31, 2000 to May 24th 2001- it would be 145 days).

What is 245 K. Is it some thing that you apply or it is just a rule for the 180 day rule.

One does not need to apply for 245k relief, but you do not need it anyways. You got a new I-94 with your COS to H-1B, therefore USCIS considers you to have been in legal status the entire time.

H1B CHANGE OF STATUS HAS THE SAME I 94 NUMBER AS DOES THE J1 I94 (ARRIVAL ATLANTA). However the J1 status was till Dec 31, 2000 and the H1B is from May 24tth 2001 (145 days).
I guess it is OK , I just wanted to give you the exact dates to see if there was anything to add.

As long as INS received your H1B application before expiration of your J1, you were fine. Since INS did issue you a new I-94, I think that was the case. You do not have anything to worry about.
