Social Security # for TD Permit holder

Hi All
My wife is here on TD permit but she is not a canadian citizen. I went to Social Security office yesterday and they said she will need I-766 & I-688B. Does anybody know what these are. They told me to goto USCIS office. Can anybody tell me how TD permit holders get their SSN number.

TD holders are not entitled to SSNs. Period. This has been determined years ago.

I-1766 and I-688B are codes for EAD (employment authorization document) which she is not entitled to. These are for people about to get Green cards, which is not happening in your case.

Your wife does not need a SS # as a TD. She can't work but you'll need an ITIN from the IRS so you can file jointly or whatever else she needs a tax ID# for in your state/county.
 
I think the desire for SSN probably stems from being asked for it for (a) Driver's license and (B) credit cards and banks, and not for tax purposes (as ITIN does just fine as webt sez)

SSA does not view either as a valid reason to issue SSN.
 
So then how can my wife apply for Driver's Licence? Is Tax ID enough to apply for a Driver's Licence?

The tax ID is NOT suitable for DL.

Check with your state's DMV. They all have extensive rules as to how those who cannot get SSN can (or in some cases cannot) get Driver's license. This is as a result of anti-terrorism laws and many TD spouses have had trouble getting DLs in the past 3-4 years.

By their processes, they did make a mistake. Unless she at one time was entitled to work, or was perhaps a student, there is no allowance for issuing an SSN for TD's or H4's, as theyt have no legal or administrative basis to need or get one.

I guess she got lucky. There is no provision to 'take it away', soI would not worry.

What were the ciurcumstances of her application (When, for what reason, etc)?

We appeared together in a local SSN office a couple of years ago when I was on my first TN (first TD for my wife) and the clerk issued SSNs to both of us without asking any questions.
 
Wow. Even back then, SSA was required to submit your TN (never mind TD) to USCIS for confirmation of status, and issue the SSN only after that confirmation, many weeks later.

The method you described (which still only applied to TN, not TD) was how it was in 2000 and 2001.

Wish all bureaucratic laziness worked to our advantage like that one did for you.:D
 
Let me tell you about SSN's!!!!!

Back in 1997 when my wife and I arrived here I got an SSN and so did she after she got her driver's license. We didn't know any better and figured it was just the thing to do. She had no problem getting it. Flash forward to about three years ago and I started getting letters from the IRS going back to 2001 about my income tax returns. They started denying me the earned income credit on my taxes for my two children. Nobody could figure out why, until we discovered that after 2001 the IRS started linking the earned income credit with an SSN. We tried to get SSN's for our kids but since 2001, SSA no longer issues them without work permission.

After five years of returns, two and half years of letters and five tax liens I now owe $32,000 !!! as of this week.

Come legally, make the wages legally but live like an illegal after taxes.

I call myself a bitter man.
 
EITC requires SSN.

There is a provision in the SSA that stipultes that if the otherwise ineligible person needs an SSN to get some form of assistance, then they will issue an SSN, but I believe that even an SSN issued under this circumstance would still not make the child eligible for EITC purposes. I'm sure you tried this.

If this did not work, then there is bureuacracy for you. Sucks.

Anyways, what I'm really sorry about is that, on TN, you were not making sufficient income to be ineligible for EIC in the first place. Talk about slave labour.

You mean "thought you qualified". As a single wage-earner, I would not move down here for less that $90K, so 55K of deductions would be a little excessive.

From your handle I see that you are living in Missouri. If I too had to live in Missouri, I wouldn't do it for any less. I, on the other hand live by the beach in sunny southern Cal.:D

And yes, I have that many deductions. Long story.
 
No probs. I just find that Tners undervalue themselves, particularly now that the C$ is so strong.

That many deductions get you into AMT territory.

To live in cali, I would accept no less than $150K. I turned down 90K in San Onofre 8years ago.

EIC is for restaurant workers, working for tips.

Yeah, I hear you loud and clear Nelsona. WA State 10yrs experience in software QA field, single wage earner, loads of experience, etc. I'm just north of $80K/yr and I'm seriously considering switching countries again simply because the market in the Seattle area will not bear a 90K/yr salary + bennies in my field.
Next stop ---> Ireland!

What's AMT category?

And I still have the $ 32,000 hanging over my head!!
 
AMT is alternative minimum tax. many cali residents, with their high state tax and their ludicrous mortgage interest deductions, end up with AMT slapped on their tax return. If you haven't had to pay it yet, you are lucky.
