Hi all.

I have a quick question. I went to a Local SS Office last week to apply for an unrestricted SS Card and I ended up receiving a restricted one ( that I already possessed ). So, I went to the office earlier today trying to explain my situation. She first asked me why I wanted some other one. After holding a conversation with her manager, she returned to tell me that I need to be a U.S. Citizen to have an unrestricted SS Card. :confused:

How do I go about this? Please note that the I-797 that my father received that verified that my case has been approved doesn't have a I-94 number. Maybe they need an I-94 number to verify my approval?

I am sorry that you dealt with people who are not familiar national rules. You should be more insisent. Did you ask to speak to the office manager?

ask to speak to supervisors.

if that does not work; go to a different SSA office or contact the SSA central office in Baltimore for help. The bottom line is that you are entitled to a normal social security card.

They need your a number. Their compuer is linked to the USCIS mainframe computer. They put in your alien number and the DHS will come back immediately with information confirming your status as an asylee. In some cases, the DHS will request the SSA to mail in your documents for further verification.

Do you have an EAD based on your asylum status?

Upon doing the research, I got confused. The only thing that I possess is the first item ( I-94 ). I don't have a work permit based upon my approval ( I still have a valid EAD good till the end of August that I received based upon Economic Hardship ) and I'm going to be applying for the one based upon my approval later this week.

In my new I-94, there's no stamp. All it has is

Receipt #, nothing after I 94#, my name, Class ( ASY ), Valid From ( Valid Indefinitely ) and Petitioner ( my father's name ).

I called the department of border patrol ( as suggested by USCIS help line ) since I fear they messed up my I 94 and its out of service or whatever.

An unrestricted SS Card isn't a must for me but I thought why not receive what I am "entitled" to. Also, when I went to my local SS Office, the lady actually talked to her manager who looked up on some documents or whatever and decided that I needed to be a U.S. Citizen.

I do have an A# in my current EAD card but since its based upon F-1 category, I bet its not gonna be that helpful.

Does your I-94 card mention anything about asylum or section 208? If you can convince them to query the DHS system using your a number then everything would be fine.
 
There's nothing in my card about section 208. The only thing it has about asylum is "asy" written in the class section. No stamps or anything.

Download and print the paper on the references submitted by Thankful.

Go back to the Social Security office or another one, insist to talk to a supervisor or someone who is well trained.

Show them what the laws say on their websites.

If after all, they refuse to give you the right social security card, make an appointment to your local USCIS office and explain the problem.

My son had the same problem, I insisted to talk to a supervisor and finally she made some phone calls (to who? I don't know), but she came back and asked the employee to give my son the right card.

I went to the Social Security office earlier and presented the docs from SSA.gov that convinced the lady that I don't need to be a U.S. Citizen to have an unrestricted SS Card. She posed me the same "idiotic" question that she asked me twice already - "Why do you need to get an unrestricted Social Security Card?" I completely forgot to take the documents from USCIS in which it clearly states that an Asylee doesn't need a Work Authorization Card and having a restricted SS Card would defeat the purpose of my entitlement.

Anyways, she went back to talk to her manager ( who had looked up and found that I needed to be a U.S. Citizen ) and she returned after 25 mins to tell me that they will have to look it up. Funnily, she made a photo copy of my EAD card ( based on Economic Hardship when I was a student ) and the approval notice along with my old SS Card.

Since I don't have an I94 number in the approval notice, I'm not very optimistic but here's hoping.

Instead of an I-94 number, they should use the SRC number of your I-730 approval. These people need more training.

They kept asking me for my EAD card so that they could get the A number but these idiots didn't even read the instructions that I presented in a proper manner. It clearly states that they can use either my I-94 or EAD ( that's produced based on approval of an asylum with "A5" shown on the category , the EAD I presented is based on Economic Hardship ) or an order from an immigration judge.
 
You get unrestricted SS card once you are approved for asylum finally or you are a derivative asylee whose cheif applicant for asylum approved finally.

Just print the UNrestricted card for asylees from SS office site and show them.
If you just got recommended approval, you don't get Unrestricted but restricted card if you go with EAD card.

I appreciate your effort to help me but you're telling me what I already know now. ;)

Would you know why there's no I-94# on my I-797A ( Notice of Action )? What's the significance of I-94? I haven't left the country ever since I came here. Does it change after status changes? Apparently, the local SS office couldn't issue me an unrestricted SS Card because I didn't have an I-94 number ( which prevented them from accessing the information about my current status albeit the I-797A clearly states that I have an asylee status that's valid indefinitely. ).

once again they can access your status with your alien registration number.
 
Would that be the same number that I have in my EAD card? ( I currently have EAD cards based on F-1 status - Economic Hardship ).

I called USCIS earlier today and a woman told me that A number actually gets upgraded as status changes.
