Should I Bother Filing The I-131?

I have been in the US nearly 8 years now, on a visitor's visa that was good for 3 months. So overstayed ever so slightly.

I married my USC fiance before my visa expired.

So, I haven't been able to go home in 8 years (Ireland), immigration processing times seem a lot faster than when we first thought about doing it back in 2001 - I could still be banned for re-entering for 10 years anyway even with the advance parole document. Should I just save myself the headache and not bother applying for it? It's been 8 years, I can hold out on going home until I have the GC in hand.

Yes Canadian, you did - and it was you that made the idea occur to me that i should skip it altogether. I mean, normally if I see a form I just automatically fill it in, LOL. I guess maybe it was just a rhetorical question or perhaps I just need an inordinate amount of validation and hand-holding with this stuff. Sorry! ;)

Seriously, you're subject to the 10-year bars if you leave the US, AP or no AP. Don't tempt yourself by applying.
