--Sent my I-485 materials a little while ago and need some advice----

Hi Everyone:

Recently I sent in my I485 materials and waiting for my receipt notice. I sent all my materials all at once, all forms, an Affidavit of support, medical exam, Bills, apartment lease etc... The only thing I didn't send was the fee because I applied for a fee waiver (Sent tax returns, bank statements and such to show eligibility.

My questions is this: I see a lot of people talking about AOS, RFI and RFE and I am not sure if I will be getting requests for all or any of these if I have already sent all the forms and documents together. So what happens now?

Also, since I am applying for a fee waiver, how much further back will that set my application processing?

I guess I am looking for a response from anyone who has been through the same situation recently or has heard of a similar case to give me more info about what I should expect as far as waiting and if they will be requesting more info or documents. I applied through TSC.

I had no idea Asylee applying to adjust status could file for a fee waiver. Are yu a refugee or asylee? I sent my i485 application with all the cash 1,010dollars on May 27th and they sent me a receive notice on June 1st. and then within two weeks i had already received an RFE for G325A and I693. am now wiaiting for approval. How did yu get to do a fee waiver?. i didn't see that anywhere when i applied for mine.
 
You can. It's up to their discretion. I tried posting a link but I wasn't allowed. Do a search on "Applying to waive I-485 fee"

You could apply for a fee waiver. This is noted on the USCIS website (refugees are automatically waived so they don't have to apply for a waiver). If you applied for a waiver, then processing time would possibly be longer because USCIS has to process your waiver first.

I sent all documents in one application.

Asylees with low income and resources have been able to get fee waivers. Requesting one will delay the case because they will decide the fee waiver before they do anything else with your application. And if they deny the fee waiver they will send the whole thing back to you for you to refile with the application fee.
 
thankful (or anyone else really!) I have some questions for you. I have to send my I-485 package at the beginning of August ( asylum approval august 8th, 2008). my lawyer is putting everything together. I have already done my I-693 and have given it to my lawyer. All the forms are filled out and completed (I-485, G-325A, I-693). Here are my questions:

1- in the G-325A form, there is one part where it says "Applicant's last address outside the United States of more than one year". my lawyer's assistant keeps telling me that this should be the same as the one that we used in I-589 where it says: "Part A. III. Information About Your Background.1. List your last address where you lived before coming to the United States. If this is not the country where you fear persecution, also list the last address in the country where you fear persecution". The thing is before coming to the states, I mainly lived in the UK as a student but visited my country of persecution for short periods of time every year. I left england and stayed in COP for a month before coming to the states. in my in the section stated above, i used both my last address in COP which i only stayed in for one month and my last address that i was at in the UK (u can put both). my question is: in G-325 (Applicant's last address outside the United States of more than one year), what am i supposed to put down? my UK address of more than 1 year or my address in the COP which i was at about a month just before coming here?

2- in G-325A, there is one section that says "Applicant's employment last five years. (If none, so state.) List present employment first.". the thing is that i have been a full time student for the past 5 years. i have done some summer internships back in COP, but that's it. in I-589, i put my full academic history where it asks for "3. Provide the following information about your education, beginning with the most recent.". however the part where it says "4. Provide the following information about your employment during the past 5 years. List your present employment first.", i just put student with no other information. my question is, in the G-325A where it says "Applicant's employment last five years. (If none, so state.) List present employment first.", am i supposed to just put down student or give details fo my academic history for the past five years.

3- i got a school letter from my school giving details of my enrollment records for since last summer, a letter from my apartment building lease office stating my residency since last october and a written affidavit by myself, stating that i have never left the US since i got my asylum approval. however, again my lawyer's assistant told me none of this is required if you have never left the country for during that one year of residency requirement after asylum approval. she keeps telling me you only need to provide evidence if you have left US. is she right? or shall i ask her to include those evidence anyways? is just one of them enough? if so, which one is the best (i was thinking school enrollment will be the best)?

4- when does one need to use any of the I-485 supplemental forms (A,C,E, etcetera...)?

5- i am planning to travel outside the states soon. i already have my RTD in hand. i will be sending my i-485 by August 8th. my plan is to leave in the fist week of september. my question is: is one month enough to receive the receipt notice and do the biometrics? or does it take them longer than that? after i do my biometrics, can i leave or is there something else that i should wait for? what are the chances of being asked to appear for an interview?

6- and last but not least, since i am sending all my documents now (medical, G-325A, etc), will i get any RFE?

I guess I was hoping I would get some info from anyone who applied with a waiver request to see how long his or her application took. I haven't received a receipt or anything yet so I am obviously still in the beginning. Also, if and when they approve it. What happens next?

1.Take it easy on this address thing. This is not that important at all. I put the address of the last 5 years, where I have lived for a significant amount of time.

2.This is fine, and again, take it easy on this.

3.Your lawyer is right. (My lawyer told me the same thing). I don’t see lease or bill make sense as these papers don’t ensure that you have never left. USCIS knows exactly whether you left the country or not. They can access your travel records easily. I just wrote one sentence in my statement saying that I have not left the country after I was granted asylum. And USCIS did not ask me for anything.

4.Never thought of this. I just followed the instructions and filled in the form. It is simple to understand and follow.

5.I got the notice to do the biometrics within a week from the date I applied. (e.g. I sent application on Feb 16 (express mail); my ND was Feb 19; my fingers print notice was Feb 25; the date to do fingers prints was Mar 25 – a month after the notice.

6. It depends. No one can answer you this question even USCIS.

I also applied for a fee waiver. It took a little more than a month for the fee waiver to be approved. Once you get the fee waiver approved, you will receive a notice informing you that processing of the I-485 will begin.

I sent my application in May. It took them one month to approve my fee waiver and that is why you see my ND is June. I sent my application to TSC.
 
Thanks. Did you happen to send in all your stuff at once or in stages? What was the RFE for? I need to take a trip and would like to do my FP before I leave. It looks liker yours took around 3 months total before you did your FP. Is that accurate?

I sent in everything except the medical because I was very sick and in bad financial shape. In the RFE, they wanted the medical and G325A form again. For some reason, I see them always requesting the G325a form for a second time and a third time for me.
 
OH OK. I submitted the medical exam too but you're saying they often ask for the G325 several times?
