when i applied for the first time which was in 2002, september, my lawyer ask me to fill up the selective service form which was supposed to make me automatically registered into the system.
but now after all these years i had my citizenship test last month and ins officer told me i was never registered for the selective service!!
my lawyer showed the officer my ins stamped papers that prooves that i was supposed to be registered, she never paid attention and my lawyer also showed her the law at the given time was saying that i was automatically registered she still did not pay any attention.
now my question is what should i do next?
i have already call the selective service, they said i am not registered and i can not register now beacause i am 32 years old.
i have my interview next month again to provide my selective service information and i really don't know what to do, eventhough i passed my test i don't really know if i am ever going to be citizen... Your help and comments are greatly appreciated.
 
Was your lawyer with you at interview? Why did they schedule you for another interview? To present other evidence that shows you registered? What did your lawyer say about this?
 
Shouldn't this be non-issue now, since you are 32 and even if you did not register is out of statuary period?
 
Unless there was something else in the OP's case that showed lack of good moral character.

As a practical matter, a male applicant over 31 years of age who failed to register with Selective Service should, ordinarily, be found eligible for naturalization unless INS has other evidence, in addition to the past failure to register, that demonstrates that the applicant is not well disposed to the good order and happiness of the United States.

my lawyer was present at the time of the interview, basically he showed the lady my applications to the selective service, he was trying to mention that i was supposed to be automatically registered.
if my understanding is correct you are telling me beacuse i am older than 31 years old selective service became irrevelant...
do i have to still get a letter from selective service for my coming interview?
 
another interview is scheduled for my 2008 tax returns and a letter from selective service, ins officer told me and my lawyer everything was ok, i passed the test she would try to put me to the next available ceremony as soon as possible..
 
INS was supposed to register you, but they didn't, so that still means you didn't register. Now that you're over 31, you don't need the SS letter, but if they bother you about it at the interview you should be prepared to defend yourself and explain that the requirement to register is now outside of the statutory period.

As a number of people have pointed out, now that you are older than 31 chances are this will not be a reason for denial of the N-400.

Given how inefficient the INS has always been, you should not have trusted them with your SSS registration. You could have registered on your own. When a registration is accepted the applicant receives in the mail a letter confirming the registration. If you ever apply for a government job or financial aid for higher education your failure to register will be an issue.

you can request a hearing and then if still denied appeal to a federal court. But do not focus on this now. first thing first.

You'll be given a chance to file an appeal and plead your case.If the IO told you everything looked ok and they will try to schedule you for next oath ceremony, why are you worried?
Sounds to me all they want to see is the letter from selective service showing you weren't registered and your 2008 tax form for informational purposes only.
Is there anything else in your case that would put your moral character into question?
 
do you think being from turkey and muslim might be an issue??because after she asked me whether i drink or not she started to write a big comment about it which was kinda weird to me..

The IOs line of questioning was trying to determine if you were a habitual drunk or not. It goes for determination of moral character. Was there anything else about your case like past arrest or citation?
 
There is something not entirely clear. So they scheduled you for a second interview so that you could bring the SSS letter and your tax transcript? Why didn't they ask you to mail those? Also, if they told they are going to schedule you for an oath ceremony next month, what's the problem? I am not sure I understand....
