Scheduled interview in the wrong country

I hope someone can help me out this time. I just called KCC and they have scheduled me for an interview in Frankfurt, Germany at February 12th. I was shocked because they scheduled me in the country that I did not want to be interviewed. Apparently the information that I updated did not get to them.

I was born in Germany but my family moved to Indonesia when I was just a kid. I'm an Indonesian Citizen and not a German Citizen nor a German Resident. I was told by the lady @ the KCC that they couldn't change the location of the interview once it's set. She said that I need to contact the local USCIS office if I'm in the U.S to do the interview in the U.S or contact the U.S Embassy in Indonesia and see if my file can be transferred for an interview there.

This is starting to worries me. I don't mind to do the interview in Germany but I don't know anyone in Frankfurt and I'm worried because I'm not a German Citizen nor Resident.

Does anyone have similar experience? Have someone been interviewed in the country where they have never been a Resident or Citizen of that country? and Have someone ever made successful transfer of their interview location from one embassy to another?

You should not have any problems transferring your case to Indonesia. The only thing it could take up to a month. Things like that happen.

I sent an e-mail to the U.S Embassy in Jakarta. I hope to get the response soon.

I can't believe they scheduled me in Frankfurt even after I sent them a new updated DSP-122.

I heard about similar cases when people who were born in Moldova were scheduled interview in Romania, regardless of where they live. That looks like a definite mistake.

what did the original DSP-122 specify as your place of residence? why did you need to update it?

I put AoS on my original DSP-122 but I changed my mind a month later. I contacted KCC and told them that I want to do CP in Indonesia instead of AoS. They told me to send a new DSP-122. I also sent an e-mail a month later to confirm the changes.

They said it is changed to CP but I didn't know that they changed the CP location to my original charge ability country, Germany, instead of my country of citizenship, Indonesia.

Finally got in touch with the U.S Consulate in Frankfurt. They told me that they will send my file to the U.S Embassy in Jakarta, Indonesia once they receive them.

I have second thought about this. It seems not a bad idea to have the interview in Frankfurt instead in Jakarta. I don't want to make my case difficult by moving files between embassy, but I'm not sure if it would be any problem to have the interview there since I'm not a German Citizen or Resident. Anyone have been interviewed in a country where they're not a citizen or resident of that country?

I also just got my 2nd NL. Nothing new, other than list of panel physicians in Germany and instruction when I get to the U.S Consulate in Frankfurt. Anyone have done their medical in Frankfurt? How long do I need to do it before the interview date?

They probably could accept your case because KCC directed it to Frankfurt. Even though it was a mistake, that could be reason enough for Frankfurt to accept it. Or they could reject it, that is on their discretion.

9 FAM 42.61 N2.1 Usual Place of Application
(CT:VISA-854; 11-21-2006)
a. As a general rule, an applicant in the United States should apply for a visa
at the post in the consular district of the applicant’s last foreign
residence. That is the only post required to accept the case for
processing, although some other post might do so as a matter of
discretion.
b. However, consular officers shall accept, when so directed by the
Department, the immigrant visa (IV) case of any alien who is a citizen or
a national of the consular district, regardless of the alien’s last residence
abroad.
c. The assignment of an IV petition to a post by the IV processing center in
the United States will constitute such a direction by the Department.
They told me that they will send my file to the U.S Embassy in Jakarta, Indonesia once they receive them.
That is not the way to go. You have to do things differently, otherwise your application will be rejected by Jakarta.

9 FAM 42.61 PN1 Procedure in Transferring Cases
9 FAM 42.61 PN1.1 Applicant Requests Transfer of Visa Files
9 FAM 42.61 PN1.1-1 Request to Receiving Post
(TL:VISA-386; 04-05-2002)
The IV applicant (beneficiary) must request in writing that the intended receiving post accept the case. There is no prescribed form or format for such a request, and the applicant may make the request by letter, facsimile or electronic mail. The applicant must send the request, along with a justification for the request, to the intended receiving post.
9 FAM 42.61 PN1.1-2 Action by Receiving Post
(TL:VISA-386; 04-05-2002)
Upon receiving the applicant's request for a transfer of the case, the intended receiving post must decide whether it will (or must) accept the case for processing. If the intended receiving post accepts the case, that post should request the transferring post to transfer the case. Electronic mail is the recommended means for making the request. [See 9 FAM 42.61 Notes for information concerning place of application.]

Thank you very much Raevsky. That quote helps me think if I should have my file transferred or not. I just got a letter from the U.S Consulate in Frankfurt:

Dear Mr .... ,

The case will be send to Frankfurt because you was born in Germany. There is no problem to process the case in Frankfurt, this is your decision.

If you wish to process the case in Jakarta we are able to transfer the case.

Please let us know what we should do.

Kind regards

So, it looks like there would be no problem for me to do the interview in Frankfurt. I think I'm going to go with it.
