Avm Not Updated !!!!

Looks like they have not updated AVM as of now. 9:15 PM PT.

I don't know what's up with DOL. Could this be that they stopped processing after Mar 31, Quarter end :(

Hope they have just forgot updating the AVM.

I thought they processed some 4/4/2003 RD cases right ? Wish they update AVM and they go forward...
My RD is 4/14/2003.

There is a message on the 415-975-4601 number recorded on 04/04 saying that they are currently processing early April applications...
 
GP111 could u pls advise me

I have a RIR pending case in BEC waiting for more than 1.5 yrs. my ETA form asks for MS +0 yr experience in civil engineering.whereas the minimum is bachelor. so I'm worried about the PW determination once BEC will come to my application. my wage is slightly above level 1 but far below level 2. i'm afraid because of the master degree, BEC will ask my employer to bump up my wage close to level 2 but my employer will not accept for sure. here is my question:

my lawyer says the company should pay me the PW once the BEC asks them about the PW because u r working in that position now. whereas a friend says,this PW is for future employment although u r working in that position currently so they have to pay u once u get the GC.

what is the accurate answer?the lawyer's one or the friend's?

is there any trick around this prevailing wage thing? please advice.

1.. If +/- 5% of PW is offered its fine.
2.. You can submit an alternate salary survey ( If BEC asks for PW wage) & the alternate survey should justify offered salary.
3..You Company NEED NOT Pay you PW before your GC gets approved as H1B LCA does not asks for it.
4.. If offered, Your company have to offer you PW after you get GC. (You can challange in the court if they do not).. BUT, If they don't, Nothing much happens. If USCIS does audit they might ask company to pay for it ( very rare)..
5.. You can always change jobs after GC / Before GC to avoide this if thats an Issue.

Again, Don't worry for Now.. Go in to all this options / thinking if BEC sends you NOF.. Keep your fingers corssed.

I thought twice, before I submitted my earlier post. I know this looks a bit confusing.

I did not mean that they may have stopped processing cases received after March 31. I know and have posted my self about the cases received on April 04, 2003 are in fact certified in the month of March.

I meant, that they may take a break processing cases in April 2005, as they did in Feb 2005. For entire month Feb 2005, they did not process any cases. Where as in March, they almost processed cases on a regular basis. We are already onto April 6, and not a trace on whether they processed any case until now.

Since we have not had any update after March 31, 2005, I just expressed my thoughts, whether they are processing alternate months.

did the BRC already start to approve cases or after 4/22 they start?

Also, don't forget there was a case of 4/11 that got certified - the lawyer received the notification, but the AVM was not updated. So, it _is_ possible that AVM is behind.

May be they are processing SEATTLE cases now, thats why no update on CA cases.

Question to the Gurus

My current LC has been filled way back in Oct 2001 CA SWA. It got remanded in 2003 and is now as regular. I think it is also transferred to Dallas BRC, but I didnt get any 45 day letter yet.

I have only 3 months left in my current H1 to finish 6year limit.

Currently I have a job offer from a different employer who is ready to transfer and extend my H1 for 7th year. (Is this possible as I dont have a LC pending with this employer for more than a year).

The new employer is also ready to file for PERM.

Folks, please let me know if there are any known gotchas in this whole process and what are the things I should be aware of before I take on the new job offer.

Yes, the new employer can get your 1 year extension based on pending LC applied by current employer (if the current employer does not withdraw it.)

If the current employer is ready not to withdraw, you can join the new one now & get extension/ apply for Perm


If not

> ask current employer to apply for extension
> ask new employer to file PERM
> Once get extension ( couple of months) join new employer (H1 transfer)..

OR
> Ask new employer to file for extension & wait for approval before joining (to be on safe side)

My CA,SFO, RIR, EB2 with PD Aug 2002 has been transferred to BPC. In my company I have got approved labor of "X" person with the same job code of mine with PD May 2002 which got cleared in CA, SFO . "X" person is not working in our company right now. I have got the opportunity to use that.

I am confused whether to go for the substituted labor of t "X" person's or stick wait for my labor clearance with BPC.

APPLY for I-140 /485 NOW & wait for your own LC as backup.. If everything goes well with substitution someone else can your LC ! Otherwise you can use it. I would not wait a minute on this

Its a Great oppurtunity to use the substitution with current unknown delays at BPC. You can immediately apply for I-140 . And check with an attorney if 485 can be filed concurrently for substittuition (Some Employers / Attorneys does not encourage to file concurrent for substitution cases for some unknown reasons)
