Lets take the worst case, if my current employer withdraws the LC and I have moved to the new one and still my PERM is under process with the new employer. Will my stay in US become illegal or H1 be cancelled.

The reason for the question being I think as a practice my current employer withdraws the applications.

Yes, the new employer can get your 1 year extension based on pending LC applied by current employer (if the current employer does not withdraw it.)

If the current employer is ready not to withdraw, you can join the new one now & get extension/ apply for Perm


If not

> ask current employer to apply for extension
> ask new employer to file PERM
> Once get extension ( couple of months) join new employer (H1 transfer)..

OR
> Ask new employer to file for extension & wait for approval before joining (to be on safe side)

Can you please let us know your case details regarding what job requiremetns were asked in ETA750 (while applying labor).

Specific to whether job requirements are MS+6months of experience or BS(or equivalent)+ 3 years of experience?

It was BS+3 years

My lawyer thinks that these letters are very common, especially for small companies (like mine). They told me (and they are a huge law firm) that they don't recall any applications that got approved without such a letter.
Sometimes, if there are more than one applications for the same company they will send such letter regarding one of the applications and then approve the rest without sending this letter...

NO.. H1 Extension Once Approved will not be cancelled because of LC withdrawl.

I think they haven't even approved a single case till this point.
You guys know any approvals from BRC.

What's going on?

Hi guys,

They keep skipping cases, they don't process them in order. They certified some cases but the skipped mine. My status still say "Received at regional Office". Any ideas, how does it work? :confused:

Are you 031 or 032? I heard they are slower than others. :(

It could be that they sent you a "3-option letter" (at least that is my case). If they do that, the status will still be "Received at regional Office".
 
Gurus, I have a question. If and when remanded cases come up for processing at BEC, can we change the requirements for the position. Since my case is remanded to state, now its a Non RIR application. The original requirement says MS+0, but can I now change it to MS+6months when supervised recruitment starts? I have MS+5 years experience but only MS+6months before my current job. Please let me know about this and the process if possible.
