YES.. Actually YOU CAN FILE TWO LCs .. One Current RIR & One NEW PERM.

This is just to make you feel better , Look at our PD's and still we haven't heard anything, And so do the math and your PD is very much later than ours and dont worry , After creation of BEC the intention is to clear in next 24 to 30 months.(dont know when they start count the 1st month :))
 
LC with PD 07/01

My LC was applied early July 2001 and was remanded Jan 2003.

By going thru the whole thread looks like my application should had processed longtime back. Looks like the FIFO stuff is not working anyways. Are there folks in similar situation as mine.

Also is there a way to figure out to which Backlog processing centre has my application been forwarded to from SFO.

If your case was remanded It has gone back with SWA cases SO will be Processed WITH FWA CASES IN FIFO.. It must be with DALLAS BEC right now. ( AS CA SWA has sent all cases to DALLAS BEC)

Even though the DOL has yet to clarify its policy on the issue of affect of filing of multiple applications by the identical employer for the identical employee, some ventureous people might have decided to file such multiple applications under the PERM system at his/her own risk. The following may not remove the risk but reduce the risk of such filing: (Remember that the new application itself will not help in retaining the existing priority by the PERM application itself, but the priority date may be preserved through the "unwithdrawn" pending application. Accordingly, for the following option or strategy to work, the DOL should eventually certify both applications and the USCIS should also approve the two separate I-140 petitions. Should this happen, the alien will be able to use earlier priority date. These requirements probably make the following strategy a useless excercise of multiple labor certification application filing. This strategy will work only when the alien files a new PERM application as an alternative to potential denial of pending application and with the full understanding that the only priority date he/she will retain will be the date of filing of PERM application.):
Check "No" to question A.1 of ETA 9089 PERM application
File for a different occupation or a different location or a different job description or requirement, which will make the job a different classification of occupation. In this case, the employer should be prepared to answer the question of bona fides existence of either of these jobs. Otherwise, it can be construed as a fraud in the worst situation.
Filing for an "identical" occupation may potentially result in the most damaging consequences depending on the yet-to-be-announced DOL policy on the PERM application that marked "no" to question A.1 when the occupation is considered an "identical" occupation with the pending labor certification application. At this time, this is a " 6 million dollar question!"

I am in the same boat. ( Remanded case, SWA Oct 2001, Remanded on Dec 2003 ). Havn't received 45 day letter yet.

gp111, do you mean ALL CA SWA cases has been transferred to Dallas BEC already? Is that mean the data entry hasn't done yet, so we have to wait a few more months for the 45 days letter, is that right? Any info on the lastest date of similar cases(SWA) have received 45 days letter?

All CA SWA Cases with PD 2004 & earlier has been moved to Dallas BEC. The Cases with PD 2005 (cases postmarked March 27 or earlier) will be moved to Dallas by next month.

We have not seen any CA SWA case getting 45 day letter. As a matter of fact There are no reported 45 day letter for any region. Regional Letters are also half done.. So Hang on for few months before you get the Letter.

Only Cases with RD 05/01/2003 & onwards have been moved to BEC
 
BEC will process the cases only after Summer.

I read an article on BEC updates on murthy.com, which idicates that, BEC's will start processing the cases only at the end of the summer. Did I interpret this correctly or you have any better news on the BEC processing schedule.
