NO.. The Filing works on PD (The date your LC filed to SWA/SESA).. & The Date retrogression in only expected in EB3.

This leads me to believe that the labor was not approved earlier. Totally confused here!

It means once you file a LC your PD has been established. That PD will be used for your eligibility of filing I-485 when your LC/I-140 gets approved.


[3] Bottomline is, does this mean that if an employee is laid off, or leaves his/her current company before the labor is certified, and the new company files a new labor, the employee retains the earlier priority date?

If the Previous employer continues to sponser the original LC (does not withdraw it) YES, the employee retains the earlier PD.

This leads me to ask you another question rgdg #3 - what if the previous employer does not withdraw the original LC, but once certified, uses it for another employee (say) or just holds on to the certified LC. Will the employee for which the LC was originally filed still get to retain his PD?

If they Just Hold the LC, the PD can be retained but if the LC has already been used (substituded) to file I-140 the PD goes away.

Hi gp111....

My RD is 04/28/2003.

The rate at which cases are getting certified in SFO, when do you feel I can hear something about it :confused:

Is it possible that the cases which has moved to BRC will hear before I can can hear the good news? If that's the case what is FIFO? Please shed some light on it.

And as usual the folks have been blessed with your answers and suggestions and I hope the same for me too.

SF DOL is in Mid March right now. If I ware you I would expect my LC to be certified in first week of New Year.

I am positive that you will be certified before or at the same time with May 2003 cases at BEC...

Points:

1/. Phil and SF. Regionals' cases will be processed together.
2/. The date to send out those letters is 11/22/04
3/. Total amount of cases for both regions are about 35,000
4/. All the cases for the above DOLs will be processed according to the applications' REGIONAL DOL's RECEIVE DATE rather than Priority Date.
5/. All the state levels will be processed afterwards

Hi Guys,

Can anyone tell me if my H1b Job Title is different than LC job title then will it create problem for me?

I am going to complete my 6 yrs of H1b term in last week of March 2005. Currently my GC application is with SF DOL with RD is March, 2004. SWA send some queries (I heard they asked company details) before it got forwarded to SF DOL.


My original H1b job title is "Database Analyst" but my LC DOT Code is 999.151-061 ie. "Database Administrator". We found this discrepancy while filing for my H1b visa extension, so my lawyer is saying we should use "Database Administrator" job title while filing for extension. I am not sure it is a good idea?

Also I would like to know how it will affect my H1b extension application and GC application?

Are the cases with RD before 08/14/2003 or cases with RD after 08/14/2004 being sent to the BECs.

My DOL RD is 06/18/2003.

No, H1b is seperate from Greeen Card ,which is a future job.

Where does this magic number "08/14/2003" come from? (Other than being gp111's RD...)

RIR May 03 & Onwards
Non RIR Oct 03 & Onwards

Where did you see 08/14/03 ? I am very much interested if you have any info for that date (it's being my RD!)

YES It will be.. As SF will be ahead of Phily & Slight behind Dallas.

Nobody knows.. Will have to wait for the letters

3. Do you know if Dallas will also go with the RD order FIFO?

Phily & Dallas should do the same thing, but again we don't have any clear info yet.
