AVM updated with transferred cases?

Hi Guys,
After long time, I checked the AVM with my employer number. Surprisingly it stopped after the July'03 cases. Earlier it used to list cases up to May 2004.
Does it mean that the rest of them are transferred to BEC?

If I go by case number it still says 'received at reg office'.

Can any one of you check?

I have checked my employer's number and cases up to Sept 2004 are still posted on AVM.

EB Numbers ready to retrogress:

In state Department’s October 2004 Visa bulletin it was reported that some EB categories would begin to backlog as early as January 2005.

The million Dollar question has been which countries and which EB categories will backlog and how much? Today we received some information from Washington DC which answers some of these questions.

The EB-3 Category is expected to regress back to 2002 for persons born in India, the PRC and Philippines. The worldwide EB3 category and the EB-1 and EB-2 catagories are expected to remain current.

That is what makes me sad. Despite the recent DOL plans to reduce the backlogs, I am wondering whether would be a good idea unite the employment greencard applicants get ready for a potential litigation, in case it is necessary. Chances are the DOL initiative won't fix things if we just get another backlog down the road in the I-140+I-485 filing. To my knowledge those i245 immigration cases granted for political motives hit the employment based greencard applicants hard. It put us behind in the backlog queues while the DOL processed thousands of illegal immigrant cases. That was unfair and unAmerican to me. In case we face further delays, I am wondering if we could take action against this. We have no political representation. We are probably one of the weakest and most misrepresented group in this nation.

When you say "regress back to 2002 for persons born in India" what date is that? is that Priority Date i.e Your Labor Certification filed Date?
 
can somebody explain what impact will this retrogressing have on us. would we be not able to apply for 140/485 or approval of 485 will be delayed.... meaning we can still use AC21

1. When the PD retrogress happens, is there a PD each for the 140 and 485 stage, or is there just one PD for both?

2. Once the PD retrogresses to, say 2002, does it usually get better or worse? That is, is it possible to move further back to, say 2001, OR when news visa numbers are made available it starts moving to say, 2003?

>>> No it does not go back to 2001... The PD retrogress to a fix date say Jan 20, 2002, means cases with PD (yep the initial labor filing date) of Jan 20, 2002 & earlier can file the I-485. Then after every month or two the PD progress forward.. feb 2002 .. mar 2002 & so on.


ON A SIDE NOTE...
CALIFORNIA CASES will not get much affected by this as we all have PD in 2002 !! Waiting long for labor also has some benifits, isn't it !

Yes.. Its PD : Priority Date (Initial labor Certification Filing date)

One cannot apply I-485 if the Priority Date is not current for that case. You can still apply for I-140 & wait for your PD to be current. AC-21 cannot be applicable before filing I-485 as it becomes usable after 180 days of I-485.

Thanks, again, for your informative answers. I believe the first line is a typo...you must have meant "One cannot apply I-485 if the Priority Date is not current ".

In this case, how is the concurrent filing of I-140 and I-485 affected if the PD is not current?

A different Question.

I have a Masters degeree that I completed only after joining the company. My attorney say they cannot use that degeree as they consider the qualification only before joining the company. Does this make sense with education too ?

Also how big a dis advantage it is being not able to use the masters degeree.

Background. MS in CS from US University(unusable now)
BS in Engg. from India. 1 year of experience in the last 3 years. and 3 years of experience before 3 years. SO totally 4 years in the last 6 years.

Please advise. Would this impact EB3 and EB2 ? (Does EB2 and EB3 get decided by what was advertised or what the candidate posess at the time of application of 485)

I-485 (adjustment of Status) application is pre requisite for EAD & AP.
