There is no Information available about Western State Cases @ SF DOL. My Post was only for California Cases. Eventually All western State Cases @ SF DOL will be moved to BEC.. What is CutOFF date.. I don't know.

Your posts suggest that there will be ONE national level Q and both Dallas and Philly will draw from that list in FIFO.

Which is correct? And is there any authoritative source for that info?

What I could understand from various sources of Info is

there will be two seperate queues TR & RIR at both BEC. Also Both BEC will have independant processing time line, since number of cases/PD are distributed evenly in both BEC there will be some SYNC in processing.
 
urgent query

Hi GP111

I am reposting my query for my friend.

I have not recd. my 45 day letter yet.Hopefully it shall come soon.

But right now I want your expert advice for my friend and colleague. His PD is sept 2002 and rd aug 2003.He has not recd. the 45 day letter as well. But he has a son who is 20 and going to be 21 in November 2005. His attorney says that he should go in for perm as otherwise his son might age out. He is EB3 and so cannot file 485 as it is subject to visa availabilty date. (which might become available by August and his labor could also get cleared by that time).

Do you think that it is of any advantage for him to file perm instead .
Please consider it urgent as he has to get back to lawyer in a day or two.

but we also heard that although there will be theoretically 2 queues (1 for RiR and another for regular cases), the processing dates of the 2 queues will be very close, which means that the RIR cases will wait the clearance of the traditional cases that came in april 2001 under 245 i which form most of the backlog, this means in a way that theoretically there r 2 queues but practically there is one. any clarification?

According to my lawyer all western states stayed at SFO.
 
Pay Stub and H1 Transfer

Sorry for posting in the wrong forum, due to urgency i have posted here. Please help.

1. I have an H1 currently with company A. I want to transfer my H1B to company B. Can I apply for the transfer though no new H1 visas is available.

2. Do we need to send pay stubs of old company when I apply for H1B transfer.

3. Can anybody elaborate the list of documents used for H1 B transfer.

4. Can i start working working for the new employer after filing for H1B transfer (and not waiting for approval)

5. Can there be any gap in the employment when swithcing employers.

This doesnt make sense. What is the point in following the RIR recruitment guidelines for 6 months and then filing for labor cert as opposed to filing a regular labor certification ? The regular labor applications will now have a 6 months time advantage. I dont know about other companies, but my employer did really follow the RIR guidelines for filing and i'd be happy if the BECs factor that into their processing time.

ALL CASES ARE THE IN THE APRIL SPREAD SHEET... Check it out your self I am attaching the April-03 spreadsheet again

You're right - they are here. When I was manipulating the data in the copy I downloaded before I must have deleted all the cases before 4/4 by mistake. Sorry!

I'm new to this so I hope you don't mind helping me understand how this works ... why would they have skipped over cases between 9556032 and 9556040 and then many between 9556040 and 9559143.
